Moving to the U.S. from the UK on an E-2?

Hi There,

Not sure where I should be posting this. My husband and I and our partners from England opened a business in Wisconsin in May 2007. My husband came here from Birmingham England on a fiancee visa in 2003. Our friends got here in February 2009 on an E-2 (I think) visa....if that's the visa for investing in a business in the U.S.

I have some major questions - am I "stuck" in a business with them for the rest of my life? I mean - will they always have to be a business owner in order to stay here? I realize if they found a business to run themselves that they could do that.

Also - they go back in August 2010 for renewal of their Visa - what is the chance of the Visa NOT being approved if the business hasn't made a noticable profit since they arrived? We have not made a profit at all since opening but the end of the year loss figures are getting smaller. My main concern is that our business can easily support 1 family (my husband and I because we could run it by ourselves) but not 2 families. Our partners could not run it by themselves and survive.

July 2002 - sent in for fiance visa.

Feb 14, 2004 GOT MARRIED!!

Feb 2004 - Adjustment of Status, Employment App. and Advance Parole papers.

May 2004 -family emergency. Return ticket for June.

September 2004 Applications denied.

October 2004 Sent I130

January 18, 2005 - I130 has been approved by email

Feb 8 - Canary Islands for our 1st anniversary!

February 23, 2005 - Affidavit of support payment

February 28, 2005 - DS 3032 sent to Portsmouth NH

March 24, 2005 - received IV bill - sent out same day

March 25, 2005 - NVC received payment

April 4/7, 2005 received I864 papers to fill out/mailed it

April 26, 2005 - Received DS230 - sent in same day

May 11, 2005 - phone call to NVC says our case was completed

May 23, 2005 - case complete and sent to London

May 27, 2005 - letter from NVC - case sent to London

June 20, 2005 - received an email from the London Consulate -

August 1, 2005 interview at 10:30 AM

VISA APPROVED!!!!!!!!

August 8 - he's flying HOME - YEAH!!!

Can't help with the specific visa question I'm afraid.

But (and I'm not having a dig here) as a former UK Tax Inspector I really laughed at the following -

"We have not made a profit at all since opening." and

"Our business can easily support one family"

I presume you mean that the business could EVENTUALLY support one family (at the moment, with no profits to draw on the implication is that you are either living off savings or borrowing). But you'll need to be a lot more specific for people to help you with the advice you need here. The losses may be reducing year on year, but how high are they at the moment? When do you honestly think you'll start making a profit and how much will your initial annual profits be?

And just to be clear - when you talk about never making a profit, please say whether each of your losses are actual physical losses - or just paper losses after taking into account depreciation/ capital allowances etc.
