I am a F-1 student who is marrying a US citizen next week.

My wife is about to graduate soon but hasn't find a job yet. Therefore her parents are going to be my sponser (joint sponser? got really confused by those terms)

The family size is 6 people plus me = 7. Under I-864p, the mimimum required amount is 37,750.

Her parent has income together as 43,500 for the 2008 tax return, with the average of 3 recect years tax income, each of them shared 50% which is around 21,000 pre person.

I am a graduate teaching assistant with income of 21,000 with no dependent

My questions

1. since my mother in law is the major sponsor and filing the I-864 for me. In part one of the I-864 form, which box should she checked?

is she the C. only joint sponser? or she has to check as D. the first of two the two joint sponser?

2. She filled out the form which includes my father in law's income in Box 24 as 21,000, and my income as 21,000. So together our total house income is about 63,000. My question is does my father in law need to fill out the I-864A form to send with her I-864 form? On their recent EZ1040 tax return form, they have the joint tax return account which states the earning for 2008 is 43,000.

Since i have no dependant. Does it mean I don't have to file a I-864 form but just give a letter from my school including my pay stubs?

3. They are both green card holder, but they do not speak English at all (they own a nail shop business). Do I just need to send the copy of their green cards? Will they get interviewed?

Here is another solution I just thought of.

If I should use my wife as my sponser (although she got 0 incomes now), then I can check A for her on the box one for the I-864 form. Since me and her has no dependant (child), we will only need to support for 2 people (16,500). Instead if I use my mother in law as sponser, so the total house income need to be at least for 7 people (37,750). Then I can use both of her parents's income 21,000 each (each of them will file a I-865 form) plus my income of 21,000 to be 63,000.

Do you think this will be a better solution that to use my wife as sponser? Only thing is that i do not know if zero income can really be the sponser...

Please help me, Thanks.

1. YOUR wife is the primary sponsor and always will be. Her parents are joint sponsors. If both parents are sponsoring she would check D

2. Yes, your father in law needs to fill out I-864a

3. Your wife always has to fill out an I-864. If her parents are in the same houshold they both fill out I-864a

4. Yes, copies of their green cards and no they will not get interviewed

YOU don't think of "solutions" It has to be done as the law requires. There are no "solutions" only compliance.

Your wife is the primary sponsor, even with -0- income. SHE brought you here, SHE is it! Her parents are joint sponsors, YOU are sponsored.

Your wife completes an I-864. Her parents each complete an I-864a. Simple. One way to do it. If you aonly want one parent to sponsor, then only one needs to fill out the I-864a.

Thank you very much for answering my question. However, I still have a little unclear about the I-864 and I-864a form.

Now I understand that my wife need to fill the I-864 form even if she got 0 income to bring me here. Both of her parents are joint sponsoring me.

My questions are.

1. She will fill out the I-864 form. Check D as "the only joint sponsor"? or she will check A as the petitioner?

2. Will any of her parents need to fill the I-864 form or just simply each fill a I-865a form since they have seperate W-2

3. If this is the case that non of my parents in law need to fill the I-864 form. Then on the item 21 (household size) of the I-864 from that my wife is filing, would she just check me as husband, herself, and g. optional as both her parents are sponsering with her as 2 people, so the total household equals to 4?

Because in the reality, her parents has 3 other dependants who are her siblings.

4. If one of her parents need to fill out the I-864 as the joint sponsor, will they have to include those 3 dependants on item 21 (household size) so the total people in household equals to 7?
