Doing AOS for a K-1 VISA for my new wife.

Working on I-864. Noticed that I qualify for I864EZ which is much easier to fill out

so I will use that.

Question 1 I had.

On I-864 it seems to not be geared for K-1 people as it lets sponsers who filled out I-130

become an a, for Part I but says nothing about us poor K-1 sponsors. I assume we should be included

as a part a. Anyone know?

Anyway I found that on I-864EZ it explicitly allows the K-1 VISA crowd in the instructions.

(Technically I-130 and I-129F are the same once you are married so I think the question is

silly but I'm a stickler for details).

Question 2:

What do we use for our income? On my taxes there are lots of different numbers for my annual income.

For lines 23 and 25 (I-864), I am guessing they want the total from LINE 22 on 1040 2008 taxes. But they might want it from Line 7 or maybe the total I was paid before all the SS and Tax dedcutions. Which is the number we fill in.

Am I right... is it Gross Income from our taxes. For this year I would guess I just put my salary which of course is higher than the gross income cause its before all the SS, Medicare and such deductions, but I do not want to spend time trying to guess what it will be especially since we are married so my tax filing status is changing.

Question 3:

I have needed so many Passport Photos of my wife in this process. There should be a recommendation to get like 16 photos at the start so you don't have to keep searching for more, especially if she is a K-1 as out of the US, 2in x 2in photos are hard to come by.

Now it looks like for the K-1 AOS package everyone is going with 6 PHOTOS! But although technically that may be right, is anyone sure you really need 6?????

Anyway we are trying to do it easier by taking one good photo, using software to make it 2X2 and the right dimensions and copy it into a 2X3 grid and print out in CVS or Kinkos onto 4x6 in photo so we can get 6 at a time for pennies.

(I wanted to do the 8$ easy route but my wife insists we save as much as possible). we have 12 more now.. hopefully that will last us for awhile.

Question 4:

After reading up everywhere, it looks like as a K-1 we don't need to do the I-693 and just use the Vaccination Supplement to the DS2053. Anyway I am planning to send away to Dr. Arnold and see if we can get the official job done with him. Doctors in the NY NJ are seem to charge way too much for that. Anyone have a definitive reply on whether we need to do I-693 or not (for K-1s!)?

Comments:

More Gotchas....

One fee for the packet covers all the stuff. No need to file extra for the 131 and 765 its included with the AOS fee.

In I-765 line 16, if you are K-1, marries and doing AOS make sure to put in © (9)... its not obvious why but it needs to be © (9).

Most folks will use what is listed in Line22.

2 for AOS, 2 for EAD and 2 for AP (if doing all three).

How about get two made, then go to Kinko's (or do it at home) scan/copy the extras you need? (No shrinking, adjusting and potentially getting them rejected).

The AOS/I-485 fee covers the EAD and AP.
