Question about N-400 based on marriage and the Supportive Evidence..

Hi everyone!

I have a question about the N-400 form . Actually its not a time for me to file it yet.,as i am gonna file it in a 6 month only.,but still very curious about the following..

When i am going to file the N-400 form based on the marriage to the U.S Citizen.,what kind of evidence should i include together with the form?

Do i have to include the same type of evidence as with the I-751 Removing conditons application?

Evidence that we are residing together as joint bank accounts,bills,car insurances,Affidavits, pictures ,joint tax returns,joint homeownerships and etc... all over again???...

The evidence for N-400 is very minimal. You are requried to present your income tax returns, so that is one evidence of your joint life. They also will have everything from your I-751 in the file, and the determination about the validity of your marriage has already been settled by that point (N-400).

We sent exactly what the application asked for and my DAH was asked to confirm at the interview that we were still together and had not separated. He was asked to show evidence of that and produced an old envelope addressed to us both. I sent him into the interview with several key documents 'just in case'.

Read through the list of requirements and you'll find that there will be docs in there that support your joint living/marriage situation.

Thank you for clarifying that for me! :star: ,but i didnt understand as what do you mean by that the officer produced the old envelope adressed to both of you? :unsure: What kind of envelope is that??? Was the envelope given to you at the time of an interview or it has been mailed to your home adress? What was in the envelope?.... :blink:

Sorry, too many pronouns. My husband was asked to show some evidence of us living at the same address. He (my husband) showed an envelope from our mortgage broker that was addressed to both our names (husband and mine). Nothing in the envelope, just to show that we both lived at the same address.

(the officer was a woman, btw)

Did you initially get your green card based on marriage? It seems likely, but someone might get LPR status based on employment, and nevertheless use a marriage to a USC to reduce the continuous residence requirement for naturalization. In that kind of case, the USCIS may never have made any sort of determination on the validity of the marriage, and it might be wise to give them all the evidence that a marriage-based visa couple would provide.

The legal requirement for the 3-year shortcut on the continuous residence requirement is that you be living together in valid marital union until citizenship is granted.

In practice, I don't know how much they check, and what level of evidence is required. In theory, if they've already found your marriage to be valid, all they need to determine is that you're still living together in valid marital union. My guess is a little bit of evidence covering the time period since they last looked at your marriage would suffice, but that's just a guess, and certainly not advice. Showing evidence of a shared address would certainly seem to be in line with the law's wording of "living together in valid marital union".

I remember reading that the "living together in valid marital union" requirement really does apply up until the citizenship oath. Courts have ruled that if the US Citizen spouse dies at any time before citizenship is received (even AFTER the N-400 is approved), the couple is no longer "living together in valid marital union", so the 3-year shortcut on the continuous residence requirement is no longer available. This is through no fault of the alien, and nobody ever said the marriage wasn't bona fide. But the marriage has to continue until citizenship is granted.

Also, the couple can't be living apart during the three years, even if the marriage is bona fide.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

Yeah,my Conditions have just recently been Removed ,so i just decided to put N/A on my profile since that happened :star: .

Also,thank you for your answer too !. I am also curious about if the new Affidavits from the same Friends and Relatives would be the necessary thing to file with the N-400 again?

As that would seem kinda weard to ask the friends and relatives to write the same kind of affidavits about our marriage all over again and again :wacko:

Maybe ,just the joint evidence as bills,credit cards,ownerhips and tax returns would be ehough to file with the N-400 form? Also we are thinking to submit a new portion of the pictures of us together from the moment of the 10 year Card approval to the moment of filing the N-400. ,thus for the additional 6 month period. :unsure:
