hello vjers!!

i came here on my fiance visa last august,we got married after 2 weeks, my husband and I went to Social Security Administration and to DMV with the copy of our marriage certificate(not the original),my passport and my I-94 which is expiring soon (october 31st) they did not give me the SS and i wasnt able to get my DMV stuff done also due to the reason that they need the original copy of our marriage certificate, "come back when you have the original copy" that is what they told me..

so we waited for 6weeks and it was only last week when we received the original marriage certicate,we went to the SSA and DMV the next day but again they did not give me because according to them my I-94 is expiring soon, and they will give me if i came 14 days before the expiration of my I-94 but how can I do that if i dont have the original copy of my marriage certificate yet???

They told me that I just need to wait for my employment card before they can give me my SS and my ID's.

We are planning to file the AOS soon we are just waiting for my husband's paycheck,my I-94 is expiring on the 31st,is it ok if we submit the AOS package on Nov 5th??or it should be filed before the expiration of my I-94??please enlighten me..

thanks to you all!

You can send AOS after the I-94 expires...I did. The only problem with it is you are out of status. Just try & send it as soon as you can.

You'll be fine filing AOS shortly after the I-94 expires (sooner the better but nothing terrible would happen if you're just past the expiration date).

You will need either the EAD or PR/Green Card now to obtain the SS card (since the I-94 is within 14 days of expiring). For others reading this - the OP could have gotten the SS card in their maiden name and not waited for the marriage certificate (would have had the card and could have returned later to have the name updated).
