Hi guys!! blessed sunday to all.. i need your help regarding our co-sponsor.. im under k1 visa petition and my fiance needs a co sponsor. could somebody tell me what forms do i need to get from my fiance aside from the form I-134? is it the form I-864 or I- 864a? pls need your help.. thanks to all :) godbless!

The I-134 is still used for some visa applications, including the K1. Good advice here is to also inquire at the foreign consulate about any particular additional requirements. Your fiance(e) needs the I-134 affidavit for the actual visa interview at the foreign consulate, so you will not be sending it with the I-129F petition. You will send the I-134 affidavit to your fiance(e).

Although the I-134 does not state minimum income requirements, there is a near 100% chance you will be required to show 125% of the poverty level for your household including your fiance(e) and any children. (See the link in the references section for Poverty Level guidelines). If you do not meet these requirements, you must still file an I-134, but you will need a co-sponsor who does meet the guidelines. The co-sponsor also fills out an I-134 affidavit.

You should make a COMPLETE copy of EVERYTHING in your affidavit package. If you decide to send or fill out the I-134 (instead of waiting until the embassy requests it later) make sure to get it notarized. You WILL use the I-864 affidavit when filing the I-485 application for adjustment after marriage, so you should begin learning about it now.

ok does make sense now.. i thought i still need to filled up i864 and give it to my fiancee when she get interview.. so i864 and i864a will use when visa got approve and after marriage.

I-864 and I-864A are needed when she adjusts her status here in US after your marriage together with I-485(adjustment of status application form)

some say co-sponsor in manila embassy are not allowed, some say they do...in my case, i have secured a I-134 from my co sponsor (my husband's mom) but when i gave it to the pre-screener he handed it back to me and told me they dont need it.

better to be prepared, just in case they ask your fiance for it.

My fiance and I are looking into this but we want ideas or information on what should we really do for this and for it to be approve cause we dont wanna waste money and time if the end of this wont work out. There are no guarantees with USEM accepting a co-sponsor with the K-1 visa. I know of a fair number that have been approved with a co-sponsor. Here are some suggestions:

Income and Co-sponsor

Information for meeting the Poverty Guidelines and using additional assets (it may be referring to the I-864 but its valid for the I-134 also):

The petitioner's income MUST meet or exceed 125% of the I-864P poverty guidelines for the number of persons listed on the tax return plus those petitioned for the K-1 visa. This isn't horseshoes - close doesn't count.

Co-sponsors with the K-1 visa normally are not accepted at USEM, there have been exceptions but normally the embassy will deny the visa if a co-sponsor is used to meet income requirements. Exceptions that have been accepted use a family member as the co-sponsor (a friend will not be accepted), use the I-864 along with the required I-134 (and supporting documents; tax return, W-2, pay stubs...) for Evidence of Support.

Hi everyone, reading all the comments here made me confuse a bit..just want to clarify things, we are planning to have co sponsor for k1 visa petition, what are the forms to be filled up by the co sponsor? Is it the I-134 and I-864? Or the I-134 only, the same with the petitioner? Pls enlighten me.. Thanks

At the interview for my fiancé, we were given a 220g requesting 2012 W2s and evidence of income. We had provided my 2012 tax returns (showing WELL over 125% poverty level) but there did not exist W2s due to foreign employment...and for evidence of income I am self-employed with a new company started mid-2013.

Since I had this ambiguity regarding how to prove my 2012 and current income, I called the USEM to ask about using a co-sponsor to ensure the requirements were met. We were being asked for something that did not exist and the self-employment affidavit used wasn't being accepted. They flatly stated that Manila does NOT accept co-sponsor for K1 visas. As was previously stated, I did find some examples where it appeared to have been accepted...so I do not believe this is a hard and fast rule.

I sent in a cover letter with details, IRS transcripts including the filed 1099s showing that no W2 was submitted by employer to IRS. I also sent in bank account statements (both personal and business), latest quarter profit and loss statements, cash flow statements, and basically overwhelmed this requirement. Just in case it wasn't accepted, I also sent in a co-sponsor i-134 from my mother that is well over the guidelines as well. The last line in my cover letter stated that if the information I had sent in personally was not acceptable, to please consider my direct family member and future mother-in-law's co-sponsor.

We got approved after at least a month of review, but unfortunately I cannot tell you if they accepted my information or the co-sponsor as this was not at interview time, but after.

Note we sent this in to an email address of IVManilaattachments@state.gov and also physically through 2GO.
