petitioning mom /NBI record

hello guys. i am a USC and my mom's petition is on process..we are now on the DS230 stage. my concern is: my mom when she get an NBI record it hit, wherein long time ago like 1975 she was engaged in that thing "jai alai" i hope you guys are familiar with that...but it never went to something very serious since nobody really sue her, she sells jai alai before and there was a raid and she was involved. now NBI people asked her to get a Municipal trial Court Clearance so they can release her NBI showing no criminal record on file which she did and her name is clear, my question is: On the DS230 form part 2, it asked if she was charged or convicted of any offense? should she answer YES??? and if yes, will this cause any problem with her visa??? please guys help me.

What is indicated on her NBI clearance. Does it mention "no criminal record on file" or "no derogatory record on file".

If there is a recod, the USEM would investigate on it and they would decide whether your petition would be approved or not...

In her NBI clearance "no criminal record on file" then she was not charge nor convicted in any offense. The Municipal Trial Court cleared her name,so your answer should be NO on the DS230 prt. 2.
