how DO people get by doing the A.O.S

In the past few days, tons of people are writing about how to file for A.O.S after leaving Canada and marrying and living with their US spouse in the US.

I'm wondering... how the heck does that work? you have to prove that you didn't intend to marry and THUS didn't intend to live down there so... how do you do that? Wouldn't it look odd if you just happened to quit your job, leave you domicile, pack away/give away or bring your possessions down with you? maybe even bring your pet with you?

i'm just wondering how people manage to get the A.O.S approved with I think it would be really hard to prove that you weren't moving down to stay/get married?

NOA #2: Approval June 25th, 2009 - 92 days

NVC

July 8, 2009 to August 10, 2009 - 28 days

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.

This is why people apply for the K-1 Visa. Otherwise people probably wouldn't be admitted unless they lied at the border and didn't get caught and get a ban placed on them...

Jan - Interview, accepted for Green Card

Feb - Green Card Arrived in mail

Oct - I-751 sent off

Jan - 10 year Green Card accepted

Mar - 10 year Green Card arrived

Oct - Filed N-400 for Naturalization

Nov - Just recieved Naturalization Interview date for Jan.

My understanding is they have to cross without the intent of marriage, and get married "on a whim."

When I see posts about people planning to cross and marry and do the AoS change, it frustrates me a bit.

Yeah, but lgg is right. There have been several posts from people planning to move and marry and do the AoS.

Which you're not supposed to do... right?

Montreal Interviewer: "What do you have in common with each other?"

Peachey: "We're REALLY weird."

Montreal Interviewer (incredulously to me): "Do you agree with that?"

<I think back to several days before the interview. Driving through the country, passing a field with cows...>

Peachey: "MOOOO! MOOOOO! Does this make me weird?"

Me: "No, well yes. Here, let me roll down the windows so they can hear you better!"

Peachey: "MOOOOO!!!!"

<back to interview>

Me: "Yes, yes I do."

Got caught and kicked back into Canada.

Oh well, it happens.

Now I'm sitting here waiting for an interview.

Well, honestly they can't be angry at me for it when they ask about the denial, cause I'm doing it the right way now :lol:

same thing happened to me... but I was also banned from the US for a year.. it had no effect on my visa though...

Just curious as to the semantics of it all -- it seems really difficult to do. Marilyn or Rhian, would you mind just telling me how you did it? I'm just curious as to how you took care of your jobs/apartments/possessions and whatnot.

Don't worry guys, I"m not planning on jumping line, we're already married, but I just wanted to hear how it can be done -- I have 3 jobs here and a lot of stuff and a cat -- I can't imagine showing up 'for a visit' and then marrying and staying on a whim -- it would be logistically impossible.

Oh? And no judgment here on you guys -- you all rock so...

Well.

I quit my job.

I was living at my parents' house.

I packed about 3 bags and I even took my dog!

I think the fact that I had no return ticket, had my dog and too many bags got me.

I didn't outright say I was going to visit my fiance or marry him, she just caught glimpse of my engagement ring and started pounding me with questions.

Got sent to Secondary and denied.

Filled out an "Application of Withdrawal" (or something) and got my ticket scribbled on with crayon so I couldn't use it. No ban for me though. Too scared to cross the border again anytime soon anyway :lol:

My fiance had been visiting and he was going back with me. It was so hard listening to him trying to find me when I was only like 10 feet away in another room. That was one hell of a depressing day.

Ended up going back to my old job and moved into town.

And here I am sitting here waiting for Montreal to dig its way out of their grave.

I think for a lot of people it would not be easy, for the reasons you outlined. I also think for a lot of people it would be very easy. If you are working at timmies, living with your parents and not paying off big bills, you get in your car, go for a visit, get married and AOS - easy.

It would also be pretty easy to justify. How about, ok, i'm going to visit my SO and see how I like it there. You appear at the border - I am going to visit my SO, they let you through - oh you like it there, let's get married and AOS.

For those that intend to stay in the U.S. and AOS, with intent to do that when they cross the border - well, see the above - is that really intent? Also, if they are not really questioned they never have to actually lie and it seems, from what I have read here - that people, during the AOS interview, are generally not questioned about their intent when they entered the U.S.

Plus, we need to remember that this is purely the honesty system here - lots of people are not honest.

I was so scared in secondary that I couldn't even cry.

I wanted to cry, but I couldn't.

Probably a good thing that I didn't.

They're like robots in there. No emotion, no sympathy, just straight by the law.

Weird thing is the guy told me to do K-3. I was like "Well how will my fiance get here to marry me, will they let him in?"

He said "It's up to them."

Guess he doesn't know how outdated it is.

Share a little story with you all... I went to go visit my husband (then boyfriend) for 4 months once. I had been traveling and had saved up tons of money and had a job waiting for me to return to. So, I packed TONS of bags, my bicycle and crossed the border. No problem. THey even looked in all my bags and I had tons of '#######' and stuff. Said I was staying for a few months to travel around. not a single issue. Not one. I had a damn bike with me!

Hung out with him for 4 months. Came back. Went back to work. That was like 5 years ago now? Neither of us even thought about A.O.S or anything like that -- in fact, he was always like, get the hell out of here, chicky or we're going to get ourselves in trouble. ;)

Thing is? We could have married and A.O.Sed seamlessly. We just didn't know and didn't want to do anything that could get ourselves in trouble for future stuff. So we waited 5 years to marry! :blink:

Not regretting it at all. Just sharing a story with you all...

I hear you, we considered doing that too - but not understanding the full implications at the time.

We were not even 100% sure that we wanted to move to the U.S. - so why go through all the immigration time and expense?

During one visit to the consulate here in Calgary (I had a question about the I-130 - this was pre-finding vj) I asked the person there - sooo what if we just pack a few things, go to the border and go live in the U.S. for a while to see if we even want to move?

She was very nice and said no, you don't want to do that - they will send you back.

Could we have done that though, in reality - absolutely we could have. Would I have done it if I knew I had to lie at the border? No way.

I pee my pants going to the border NOW armed with a billion ties to Canada! Imagine if I had to lie? Adult diapers couldn't help me then...

I'm happy we're doing it the legal way, I'm not happy to wait but when it comes time for us... it'll be a thrill.
