I recieved a letter from NVC for the AOS fee. will this be for the interview(I-134) or after he adjusts status(I-1864). I also want to know. if they didnt ask for I-134 from my husband, do i still have to do it?

CR-1/IR-1 don't use I-134s.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

you have confused abbreviations

AOS = Affidavit of Support = I-864 <---- applys to IR-1/CR-1 and AOS bill

AOS = Adjustment of Status <--- does not apply to IR-1/CR-1

it is for the affidavit of support. I need to know if i need to pay this now if it is for the I-134, or if i can wait and pay it after he comes here and we process the I-864. It is for the k-3 spouse visa

If you pay for it now, they may stop processing the K3, because it is for the CR-1 and I-864. If you don't pay it, processing for the CR-1 will not proceed and you can process the adjustment of status after arrival in the U.S. There is no fee associated with the I-134 used for the K-3, but there is an application fee for the K-3 visa interview. If you continue with the K-3 instead of the CR-1, you will need to pay $1010 for the adjustment of status later.

Paying the fee now and waiting for the CR-1 interview is often a better choice as you enter the U.S. as a permanent resident and are immediately able to be employed and get a SSN and you don't have to adjust status and you don't have to pay $1010 for the adjustment.

Also, if you pay that fee now, but end up getting the K-3 instead of the CR-1, the fee is lost unless you continue with the CR-1 and return to the consulate for the CR-1 interview.

wow! perfect! thank you,

by any chance would you know if i still have to do the I-134 if my husband was not told he needed to have it at the interview?, know it states some us embassys require it and others dont.

I don't know. You could contact the consulate or just prepare one in case he needs it. The safest thing to do would be to have one ready. If it's not needed you are covered and if it is needed you are also covered.
