Help! NBI arrest record,

Hello Everybody,

I hope that somebody will enlighten me about my issue.

I just mailed NVC my requirement requirements but on my DS230 form part2

#31. Have you ever been charged, arrested or convicted of any offense or crime) (If answer is Yes, please explain)

I checked 'No' instead of 'Yes'.

I was previously charged but the case was dismissed. The case was about video copyright VRB that I have in my computer shop premise, but I was wrongly accused.

I was cleared in court.

My question:

Does the embassy have my record already since it was the nbi who raided my computer shop.

What will happen then that I have ticked 'No' instead of 'Yes' of this record.

Will this cause a denial for not disclosing everything. Or is it okay if I'll bring the court dismissal on my interview.

What chances do I have?

You have provided false information. The question is have you ever been "charged, arrested or convicted." You were charged. The fact that the case was dismissed does not mean that you were never charged. You should have said yes to this question and then provided an explanation.

Whether the immigration folks catch this or not is unknown. I presume that copyright violation is a criminal offense and not a civil one. Were you arrested and taken to a police station?

By the way, what does NBI stand for? Who are they?

You have provided false information. The question is have you ever been "charged, arrested or convicted." You were charged. The fact that the case was dismissed does not mean that you were never charged. You should have said yes to this question and then provided an explanation.

Could be the FBI, ironically the fine/prison term for copying a DVD is identical to fradulently bringing an alien to this country. Figure that out. Another observation is what we called double jeopardy in the US military, for any civil offense that one had to pay the price for, that price for the same offense was far more severe in the military with even AWOL tossed in if the delay made you late for whatever. You had to be very very good. USCIS is the same as the military in this respect, but perjury seems to be the most major of the crimes.

Would correct it explaining you misread the question and provide your documentation, you would be far better off if you freely volunteer this information, then being caught.

Really had to watch my kids with these peer to peer MP3 sharing bits, a college student in Duluth got fined a 1/4 million bucks for this, but one would think the FBI would have better things to do, like preventing 9/11. Crazy with that DVD thing, legal to copy the same movie off cable in HDTV, cable companies are even pushing digital recorders for this. Guess the FBI wants to make sure your copy is of better quality, not that there is anything worth copying.
