I-751 Filed -- Now Deportation Letter

Don't worry, it will be fine. I had a bad experienced of my removal case also. We almost had heart attack..hehehe..(it's funny now!)But anyway, We're been waiting and waiting. And what we received?,just next day my green card will be expired, they sent my application back because of outdated form. And we got it friday aftenoon. And we're just panicking,so my husband called @ the office of our congressman's office and we sent back the application right away. And we made an appointment @infopass. My husband made a letter to the congressman and sent it through email and we made a copy attached to our application. But anyway,contacting the congressman helps us because I got my green card after we sent everything for more than two weeks. So please call your congressman or senator and they can help you. Especially you're pregnant. Take care yourself and don't make this thing worry you.

Thank you. I just sent an email and snail mail letter to my congressman. I also explained that my original faux pas with the incorrectly made out check. Instead of writing U.S. Citizenship and Immigration Services, I wrote U.S.C.I.S.!!!!! WOW! The Infopass appointment is scheduled for next week.

PS....do you think I should sent back a copy of the package and ANOTHER check or wait until after the Infopass appointment? I refuse to lose my husband this way.

Thanks! I have that on my 8AM to do list. I also plan to resend the package (only have copies now) and the fee (will send a money order this time) tomorrow morning too.

CALL your congressman or senator! Mail or email may not make it.

:thumbs: I emailed our congressman when my wife's medical and followed up with a call. They said they didn't get the email at the local office b/c someone else handles it...I think. Anyway, a call is the best way to go b/c at least you have a name at the office to talk to where an email might get ansewed by a whole bunch of random people.

Thanks, Lucy. I'm just not sure how this happened. I've been kicking myself all day for not doing delivery confirmation. I'm just confused about why we wouldn't have received anything...no reminder letter, no where is your check, no nothing before this. We were at the same address up until the middle of this month and even with that we filed all appropriate address changes. It just seems strange that the money is still sitting there in my account and no one seems to know what's happened to our paperwork. All I can do is pray and take the copies, including the new check, of everything I sent. I'm not sure if I should cancel the check and take a money order with me. Take a money order with me. I'm at a loss. I am even scared of the Infopass appointment. With this medical condition, I rely on him for so much. I'll keep you all posted and thank you for the support!

Unfortunately, USCIS is NOT obligated to inform you that you are due to renew your green card. The onus is on the alien to keep track of that. I believe they are now sending notices more routinely (we got one), but that hasn't always been the case. And even at that, they inform you when you get the 2 year green card that they will not remind you.

They certainly wouldn't inquire as to 'where is your check' - they have no tracking system for that sort of thing.

You have the returned package/check - that alone gives you a pretty good leg to stand on. Even though it was your error by making the check out incorrectly, they can see that you made a good faith effort to comply. I'm sure the Infopass appt will go fine. :thumbs:

Thanks, TracyTN! I hope things are going well from you. I remember you from early on in this process. I suppose my stress is messing with my ability to convey myself properly...lol. I just wonder why we didn't receive a removal of conditions or anything before the letter advising us of the intention to schedule an Immigration hearing. In any event, I spoke with the Congressman's Immigration Specialist this morning and she was very helpful. She explained that packages are being bumped to satellite offices and it is entirely possibly mine was lost in the shuffle. She advised me to send everything again,, go to the Infopass with proof that I have and that they would be sending a formal inquiry. I'm guessing they don't deal with a lot of these types of cases here in rural WV. She seemed kind of (weirdly) excited to look into it and really gave me a sense of hope by stating that we obviously have made a good faith effort and these are not the sort of cases they wish to see going to court. Now....if I could just get through on my old friend...the 800 number.......

Good luck! I would recommend a personal check thou. so you can see when the check is cashed!.

I agree 100% with that about personal check. I almost had a similiar situation because I sent a money order and it is so hard to track it down. Use a check to show they received.

If I were in your situation I woud call the senator's office and ask them what I should do first. They do respond.

You need a lawyer ASAP...

A lawyer is always an option, however, it seems the INS is a little kinder and gentler these days. I called them and they were downright friendly to me and helpful also.

Sorry for all the updates and thank you for your support everyone! I just spoke to someone at USCIS and they DO have record of our initial filing, but not the second submission. I already sent it out this morning, but she advised resending with a letter explaining all of this. Then explained the worst case scenarios of having to see a judge or submit the I-130 & I-485. At least I know they do have record of my attempt to file within the timeframe. Huge load off my mind!

Agreed! Even compared to our original petitions, this customer service rep. was downright helpful and friendly. I actually enjoyed speaking with her!

Just a quick update! On Sept. 3rd, we had our InfoPass appointment. They advised us to resend the packet and fee. On Sept. 4th, we sent out everything included a letter explaining our previous filings, copies, and the new fee. Today we received the I-797C, 1 year extension dated Sept. 14th. Hopefully, we'll hear about the ACS appointment soon.....hopefully, we will receive his renewed passport back first ;) Thank you so much for all your help! I cannot explain the gratitude I feel for all of your advice.
