kids AOS denied..re: ABANDONMENT

Hello everyone!

Im hoping someone here could help me what i need to do regarding the AOS of my children from previous marriage. Last month, my husband and I had a very big fight that I had to moved out the house and live with a friend. I had my address changed in the post office and called INS later on. During those time frame, INS already sent out a letter requesting for evidence but since at the time that they sent out the letter I'm no longer living in that address the postman sent it back to INS. But INS customer service got that 'taking care of' and requested for 'resending the request for evidence'. They said I should receive the letter within 14 days but 14 days passed by and I havent received any mails from them so I checked out the case number online and found out that they already sent it out to my NEW ADDRESS but the postman sent it back to them as UNDELIVERABLE. So, I called INS and let them know that Im still living in the address that i gave them before and i have no idea why the postman sent it back to them. The INS customer service said she will inform the one who is handling my daughters case what happened and will request to resend it again and expect to receive it within 14 days. As i checked my email today, I got this email from INS that my kids AOS had been denied due to abandonment...I was shocked!!!! I called INS and asked how it happened..i did what i supposed to do..I called them when i changed my address and inform them too when i didnt received that letter the second time when the postman sent it back to them. I have all the confirmation letter with me to prove that I am updating them all the time. The INS 1800 said that since its already denied i just have to reapply. Is she kidding me?? That's already $2400 thats wasted because somebody didnt do their job. It took me a 2 years to save that money for NOTHING. Please, somebody who know about immigration tell me what i need to do..i can't afford to give INS another $2400. Thanks in advance!

About the stupid postman..she said because she doesnt know me that's why she sent it back to INS. Im like, what the point of filing out those paper for change of address if all i got to do is get to know the postman personally???...

Dont bother calling the 1-800 number, make an infopass appointment at your local USCIS office take all the evidence with you to show that you notified USCIS of your change of address. They are the only people who can get this fixed for you. You may also want to contact your senator to see if he/she can help sort this out.

An FYI for readers:

Putting in a forwarding address with USPS doesn't guarantee important correspondence (such as government letters) will get forwarded - for a foreign spouse, the AR-11 (plus a call) will do the trick.

Also - this is another perfect example of why it is recommended to list the names of everyone living at an address INSIDE the mailbox (inside the lid, or in an appropriate place where the carrier will see it). You don't have to get to know the postal carrier, but you can help them, help you by doing so (list yourself and all children's names.)

As stated above - make an infopass to get this resolved.

maybe you can have the postman put her explanation in writing, it'll be a good proof that it was not your fault you didn't receive the letters.

UPDATE!!!!!!

Used the infopass friday and talked to an IO, showed her the confirmation letter from them that I made phone calls (informing them I still live in the address that i gave them a month ago and I have no idea why the postman sent the Request for Evidence back to them ,)prior to the date they denied the applications. It took her almost half an hour looking up on her computer and said that once I got the Letter of Denial, I will make a letter explaining that I never got the Request for Evidence and that I made a phone call, write the confirmation letter of that call and say I made it 3 days before they denied the application. Asked if I need to pay?? she said I shouldn't have to because I got proof that I made a call...So, now still waiting for that Letter of Denial...talked to our Local Postmaster,she gave this crappy letter that the mailman that assigned in our area that time is on sick leave and it's the substitute mailman is the one who returned the mail back.Asked what's the name of the substitute mailman, she said she don't know....haha!
