Hey all!

Ok, i'm new to this forum. But, I need major help. I wasn't really sure where to post this, and since its not really on the topic of any of the visa's listed, I figured i'd just put it in the off topic forum. Ok! I was looking online tonight and realized my fiance can be here tomorrow afternoon really cheap. We haven't seen each other in almost 5 months and i'd love more than anything for him to come. My dilemma is.... he was here from April - July 2005, and then from Nov - Feb 2006, neither time on an overstay. But, i'm afraid that immigrations might hastle him. Do you think they would deny him and send him home? What i've read so far, they've only done that to people who had an overstay. I'm sooo nervous, I want him to come, but i'm afraid of the consequences!!!

Please write back.

Thanks in advance!

PS. He can come in on the Visa Waiver program

Might they hassle him? Yes. Then again, they might not. You won't know if you don't try. With no overstays, he is still eligible for the VWP butt he final decision rests with the immigration officer at the POE.

That being said, there are steps you can take to make the hassle less, should he be pulled aside for questioning. The POE officer needs to determine that your fiance will, beyond a doubt, be going home at the end of the visit; so anything that can help prove that will be of assistance: tenancy agreement or mortgage papers, bank statements, current payslips or a letter from a job stating an expected return date, class registration if he's a student-anything that can "prove" he's coming back to the UK.

Even if he attempts to come in and is denied, it won't affect your visa process. It's not deportation, and it's not the end of the world. Bottom line is, you won't know until you try. He might not get any questions at all, God knows my husband walked through with no problems most times.

Good luck, and welcome to VJ!

will they take pics of my cat as proof? :D j/k i'm the person in question here and it sounded like it may be difficult. however i'd never had any problems getting in before, although i did have a guy at Cincinnati customs who i've nicknamed 'thunderface' due to him only smiling at me once while he was questioning me. however they seemed a lot more concerned to the matter of me bringing in foreign flora and fauna which i'm almost certain i have  in short i want this. its been a long time since we saw each other and although very sudden, i believe we can do it.

I think it's worth giving it a shot-the worst that happens is that they send you back. The only issue I can see raising a red flag is that your two previous stays were quite long, being the maximum time allowed. It might raise some eyebrows at the POE. Just be prepared to be asked to prove that you will leave, that's all!

Good luck! I hope the two of you are reunited tomorrow!

 Tall, slender, dark haired man? When hubby was pulled to the side a couple of years ago, for two hours, this guy really tried to trip him up. He repeated the same questions over and over, went through every item in his suitcase, then called me back as well. I must say he does his job well.

I also watched a younger man interviewing another Brit, I think he was worse than the one we got stuck with. Seemed that day Brits, and the French were targets.

Just be matter of fact, look the guy in the eyes if you get pulled to the side, and bring plenty of evidence that you will return to the UK.

I think we're going to go for it. As soon as I can make sure with him that he can get the airport and everything. I'm sooo excited, I hope this all works out and customs is a breeze. I can't wait. I'm getting a stomach ache thinking about it!!!!

I went during NOA2 stage - and I did get asked reason for visit. I first said a friend, which was true, technically, lol, but when pressed I said boyfriend..and then got asked for proof of return - I had e-tickets but Id printed out my itinerary (I cant spell that word!) and showed him that and all was fine.

I also had (and this is pretty lame I know) a letter with a dental appointment on it (lol) - and a copy of my old mortgage showing my name on it, my daughter's flight info (I had to be back in UK to pick her up - I thought this was my best evidence for needing to return), my NOA2, and a saving account statement - that was all I had, but he didn't ask for anything else.

tho - I never stayed for such a long time as you guys.

Good luck!

Well we haven't applied for a visa yet (we're hoping to get that started when he's here this time) so.. he'll just be coming in a visa waiver. Which, i'm not sure if there are any regulations to how many months you can spend in the US in one year, but this year... he's only been here for about a month and a half (2006 year) I'm thinking it'll be ok.
