Hello; I have bit of confusing situation. I have received my visa which is expiring in feb 2010. but my 2nd wedding anniversery is in march. If i am going to enter in feb 2010. i will receive CR1 visa, where as my 2nd anniversery in in march 2010. and according to visa law i should get IRI visa after two years of my marriage. Any suggestions.

my hubby was told at the time of interview by the CO that he has approved my hubby's visa as a IR1 since we have been married for 2 years....

you could give it a chance by talking to the officer at POE

The only way you are going to get a IR1 Greencard is if your arrival in the USA is AFTER your 2nd wedding anniversary. It could be the day before your anniversary and you would not get a IR1, you would only get a CR1.

As your visa expires before your 2nd wedding anniversary you will have to enter the US and get a CR1. You could contacy the embassy and request an extension becuse you want to wait until after your 2nd anniversary, but I doubt they would class that as a valid reason for extending the visa.
