I recently submitted my AOS application (I-130 and I-485), with the help of this wonderful forum. Thank you very much to everybody here for your contribution!

My application contained form I-601, since I could not provide proof of vaccinations on the medical examination form (I-693). I prepared my package based on the information on this site: http://www.visajourney.com/forums/index.ph...page=i130guide2. This page and many other pages state that there is no filing fee for I-601 if it is filed concurrently with I-485.

Unfortunately I got a Notice of Action (I-797C) in the mail today, saying that my I-601 was rejected since I have not provided the $545 filing fee.

My question is: Where can I find evidence that the filing fee for I-601 is not necessary if filed concurrently with I-485? What argument will USCIS accept to waive the fee?

You do not need to file I-601, if you do not have proof of the vaccinations needed then go have the vaccinations done again or have the test done to show you have already been vaccinated.

I-601 is for people who are not admisible to the US because they have TB or a mental illness or have commited a crime, it is not for lack of proof for vaccinations.

I had to file I-601 since vaccinations are against my moral convictions and therefore I cannot get them done.

Is there anyone who successfully filed I-485 with I-601 without paying the $545 filing fee for I-601, like it says in the instructions?

Good luck with that one... in 5 years I have never heard of anyone getting a wavier for vaccinations becuse they dont belive in it... Only one I have seen that got the wavier was because of an allergy to the fluid use in the vaccinations.

The USCIS changes fee rules at times, and pages on VJ are guides, not policy. You need to read the official instructions for the I-601. The instructions don't say anything about the filing fee not being required when filed with the I-485. At least, I didn't see anything on a quick read.

You might also ask in the waivers forum.

I suspect the VJ guide is either out of date, or just in error.

Possibly because it the USCIS you are dealing with and not an internet forum, so I am taking a wild guess that you should take notice of what USCIS says. A forum is only here to help and offer general guidance. The USCIS updates and changes at an alarming rate so it is always wise to read their forms carefully and not to rely on anything other than official guidelines.

You are filing the correct form but it is a multi purpose form not just for the situation you find yourself in.

Re Form I-601 USCIS says this, perhaps you didnt read it on the form

The fee on this form is current as of the edition date appearing in the lower right corner of this page. However,because USCIS fees change periodically, you can verify if the fee is correct by following one of the steps below:Visit our website at www.uscis.gov and scroll down to "Forms and E-Filing" to check the appropriate fee,or

Review the Fee Schedule included in your form package, if you called us to request the form, or

How to Check If the Fee Is Correct.

Telephone our National Customer Service Center at1-800-375-5283 and ask for the fee information.

No fee is required is required if this application is filed for an alien who

Is afflicted with tuberculosis;

Is mentally retarded;

or Has a history of mental illness.

Do you fit any of the above categories?

Also see page 8 (top right) for further info re fees there may be something else buried on their website but i am not aware of it. Perhaps someone else knows differently? It isnt the most user friendly site on the web.
