So I've searched this forum for every bit of information I can find on how to cancel/withdraw a K1 petition that has yet to be approved. What I come up with is that I basically need to send a letter to the service center where my petition was filed and let them know I want to withdraw my petition. Sounds easy enough.

Well my first attempt the letter had a return to sender sticker on it and the reason in handwriting said, "Recipient refused. Improperly addressed". WHOA I don't understand 'cause I just used the same address that I used to file the petition but the only difference being I did not put the "ATTN: I-129F" part. I only put:

USCIS

Vermont Service Center

75 Lower Welden Street

St. Albans, VT 05479-0001

So I sent the request again this time I only added the "ATTN: I-129F" part and it was accepted this time. 2 weeks later I called to see if they indeed received it and the guy on the phone told me they don't have that information available to him. He did ask though if it was handwritten and my reply was no that I typed it and signed and dated and included a copy of the original NOA1. He told me that I should resend the request but handwritten this time which I immediately did.

That was about 2 months ago and the guy said I should receive an confirmation within 2 or 3 weeks. As of today I've yet to receive any kind of confirmation of any sort. I just checked my case online and it was touched yesterday the 7th but still not cancelled.

I have a few questions for those of you who've successfully had their petitions withdrawn.

  1. How did you address your envelope?
  2. Did you notarize your request?
  3. How long did it take to get a confirmation?
  4. Should I worry at this point? I really don't want the petition to go any further.
  5. Any other advice? other then to relax :innocent:

Not sure how many responses you'll get from those who have actually withdrew a petition - most probably didn't hang around after.

But let's back into this from a different point of view.

  • The address - of course you should address the letter/envelope similarly to what you did for the petition. If it were me, I would not only put ATTN: I-129f but also "PETITION CANCELLATION" on the envelope.
  • I would include in the letter all pertinent information - i.e., case number, my name/address etc, the beneficiary's name/address etc - a brief explanation stating clearly the petition is to be withdrawn and finally a copy of the NOA1.
  • I would probably get my letter notarized so there would be no question I (the USC/Petitioner) am the one signing the letter.
  • I would send all this via USPS priority with delivery confirmation. I would expect some sort of response within a couple of weeks - not months later. USCIS will send you a confirmation.

You don't have a timeline so is it safe to assume the petition has not yet been approved and forwarded to NVC or the Embassy/Consulate?
