going to the US while K1 pending

Hi everyone:

I plan to visit my fiance in the US over the next week, departing from London. I have my employment letter and landlord contract. Is it sufficient? Anyone can give me some advice according to your experience?

Well, this is a common question here on VJ, about visiting during the K-1 procedure. In my opinion, an employment letter is one of the best pieces of documentation. Hopefully it has the date you're expected back to work on it. Another idea might be to take your 129F package, or some type of notification copy, like a NOA1 etc. If you're questioned a lot, you might want to add this to evidence to show the CO that you're going to be immigrating, but are going about it this way, and not trying to get in now to do so.

Basically it's a ####### shoot though. It's up to the individual officer at the border to use their discretion on letting you enter. Always tell the truth, and always be prepared to not be let in.

Thanks! I have an employment letter with date on. I also have a landlord contract. My fiance and I asked a lawyer to prepare K1 for us so I don't have the whole pakage. However, I have the letter for NOA1 forwarded by the lawyer.

Previously (before we started applying K1) I have entered USA several times for visiting my fiance and always return on time. Will it ease my visit this time?

Previously (before we started applying K1) I have entered USA several times for visiting my fiance and always return on time. Will it ease my visit this time?

Yes, have the lawyer fax you a copy of the NOA1, that might help. Actually, depending on how often you've visited your fiance could maybe hurt your chances. Maybe they'll think you're visiting too often. Have you always said you're visiting your fiance? I don't think it will ease your visit. Again, each individual officer will ask you different questions. If you're prepared to answer questions honestly, and have documentation to back up your statements, you hopefully will not have any problems. Many, many people visit while the K-1 is ongoing without any problems whatsoever. I just want you to know that you could be turned away, even with the evidence you have.

Previously, I visited him quite often, maybe once per month or even twice per months. However, the last time I visited him was on March. I know there is a risk but just want to minimise it. Thanks for your help!
