Hi all!

I really need your advice.

After the AOS, the NVC informed me that I should submit all the necessary documents needed to further process my application. One of those documents is the NBI certificate. However, when I got a copy of my NBI certificate, it showed that I have a pending case - a Malicious Mischief case filed to harass us over a land dispute, its still ongoing and it's on its 6th year and I honestly don't know how much longer it will take to finish. This is the only thing that is keeping me from sending my documents to the NVC.

My question is this. If I send my NBI certificate as is, will my visa application be denied? What can I do to prevent this from happening? I know this is a legal matter but I'm hoping that someone here has been through this kind of situation or perhaps currently going through the same ordeal.

I asked Marie, and she says you have to find some "other" way for the NBI to give you the clearance you need. I don't know what that means. :unsure:

Other than that, I don't know if the USEM or NVC would be satisfied with an explanation only. If you feel you can not resolve the case in time, I am assuming the "Malicious Mischief" means "Willful Destruction of Property", then see what form of restitution is required to make the case "go-away".

it would be better if you bring court records if you have them to the interview . if you will be denied then you can apply for a waiver , i think .
