Hi...I have a few questions about the Adjustment of Status, since my and my husband don't know what is going on:

I have my interview appointment for my K3 Visa in Naples (Italy) next week and, hopefully, I'll be in America on a K3 Visa and then file for the AOS and EAD.

Now, we don't understand a few things:

How long does the green card normally take to come? we've seen a lot of people's timelines and they got it in 6-7 months....but when my friends called the INS service number they told us it takes 2 years....

We also have been married for almost 2 years (a year and 10 months) but by the time I'll get (hopefully) my permanent residency it will be more than 2 years....Will have I the Conditional either way?

please....somebody explain us!!!!!! :help:

Mar 6 2006 - RFE for the I-130 (Marriage Certificate)

Mar 14 2006 - Sent RFE to CSC

Mar 21 2006 - RFE received by CSC

Mar 30 2006 - Detroit POE - Got the I-94

Mar 31 2006 - I-130 NOA 2 - APPROVED!!! (170 days)

How long the green card takes in the AOS process depends on many factors - case workload at the district office that will be processing your case, pure dumb luck, etc. It can vary from a few months to many years.

And if you've been married > 2 years you will not get a conditional GC.

You need to find out what the District Office is for the city in the US where you will live.

How long it takes for your AOS appointment (and Green Card to follow) depends totally on your District Office.

If you are married more than 2 years when your AOS is approved, you will NOT have the Conditions on your card; your card will be valid for 10 years.

Thanks a lotfor the information....on the AOS form they say that people with the K3 Visa have to file the AOS to Chicago Office....but I live in Ohio and my husband is from there, close to cleveland. Can I file in Cleveland or I have to file it in Chicago?

Maria, please read the instructions *at uscis.gov* very carefully so you file your papers correctly.

The papers are mailed to Chicago and they will send them on to your District Office at the right time.

Go very carefully so you do not make an error!
