When I submitted our initial visa application, I was about to move, but didn't have a new apartment yet. I was on poor terms with my roomate at the time, so I just used my parents address for the forms. Well, our application was approved and we got married and are in the process of filing the AoS. However, I forgot to change my address with USCIS when I got a new apartment 8 months ago. Now that we are filing out the paperwork for the AoS, I read about the I-865 form for a change of address. My question is, Should I file the I-865 before I send in the AoS submission, or just use the mailing address that I used for the initial visa application, or can I just simply continue to use my parents address on the AoS application for simplicity?

In my opinion - you should use the address where you live now (call me silly)... If you're about to file your AOS - I would just simply use your current address on all the forms and skip the I-865.

Side note - did you guys do an AR-11 (Alien Change of Address)? (same advice as above if not)

I just tried to file the AR-11 and realized that the I-94 expired yesterday. What kind of trouble am I looking at now?

I'm not sure there is a penalty - just get it done as fast and best you can - filing the AOS will sent things right - you should do so as soon as possible.

Thank you very much. I am filing out the forms as we speak. One last question. On the I-485, it asks for "USCIS Status" and then across from it it asks for an expiration date. The I-94 expired on monday, but the K1 Visa expiration date is September 15, 2009. I have provisionally put "K1 Visa Holder" under USCIS Status and the visa expiration date. Is this correct, or should I put the I-94 status and expiration date?
