So all the forms say that when you move you have to notify them about the move. With good reason. But I had a question about the Affidavit of Support. My wife submitted an 864 using her current income.

Long story short:

- Applied for AOS in April (wife makes more than 125% of poverty, more than double)

- Wife hates job wants to quit (or may get let go :( )

- I got a job offer in California (we currently live in DC and I make more than 3 times the poverty req) which would pay 4 times poverty level

I spoke with USCIS today and they said the office in our area was processing cases from October 2008. So we've got a long ways to go waiting for that.

So I have a few questions:

1) She filled the i-864 on her own since she more than doubled the ppverty requirements.

- If she quits I'd like to submit a i-864a along with the i-864.

- Can I submit that at the interview or do I need to submit it now?

- Do I submit a totally new i-864 + 864a or just an 864?

- And finally, I've only been working here since 2007 so I don't have a tax return in 2006. Do i put 0 as my US income (I made Canadian income but obviously didn't file taxes in the US) and attach a letter stating I didn't file taxes in the US but in canada and include a copy of my 2006 canadian return?

2) Will moving have any adverse affects on the case?

OK.

Interview, and only if they require them

Yes to the former.

864 only requires most recent tax info. 2008. If you want to show 2007/08, then a statement stating you were a Canadian (not required to file US taxes in 2006) would be sufficient. (you don't need your Candian return)

Maybe - call them several times to ensure your address was updated (and make sure the USPS knows your change of address). Missed RFE/Appointments are doom to the process.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Well that right there is some sound advice! I never thought the easiest thing to do (changing address) would be the thing to be most stressed about.
