Okay, here's the situation ... My husband (a U.S. citizen through marriage) petitioned for his parents to become LPR's. They all live here in the U.S., so we filed the I-130/I-485 concurrently. Everything was VERY fast and they received their green cards late last year - that's all great. My question concerns their 17 year old daughter (my husband's little sister). I was the one "counseling" them and I fear I may have missed something. For many reasons, we decided not to file for his little sister. Money was a big issue. Also, I was under the impression that as a sister - even though she is a minor child - her wait time will be forever long (10-12 years+). The other part of it is, his family entered on Visa Waivers. Well, if you're an immediate relative (like his parents are), you can adjust your status, but as a sister, my understanding is that you cannot. So even though a I-130 may be approved, she can't file the I-485 anyway.

Did I miss something? My sister-in-law (husband's brother's wife) recently called and the info she is relaying to me is that the immigration officer told her there is something about a "ride on." She said the I-130/I-485 for the little sister should have been filed concurrently with the parents and she would have been approved as quickly as them. This goes against everything I've read and MY conversations with immigration officers.

I just worry ... have I cost my sister-in-law years? At this point, we have to wait until her parents are citizens and then it could be another 5 years.

Can anyone confirm?
