Sis, back up a bit...what exactly happened 4 years ago?

Give us more details, i mean exact details of your situation before we can assess what happened.

What documents did you send in, what was the RFE about, when did you meet, when did you get married... important details that led to your denial.

YOu also might want to post this at the CR1/IR1 forum.. there are more people there who can help you.

I'm sorry for this... and the least you can do is regroup and refile.. that's the worst case scenario.

You need to act quickly now to try and keep your I-130 petition in Manila. You only have 30 days to appeal the denial. I would suggest contacting a good immigration attorney familiar with USEM visas. If your husband has become a USC, have him contact his local Senators right away.

VJ FAQ:

What happens if my I-130 petition is denied?? Can I appeal??

Yes, you can appeal. If for some reason your I-130 petition is denied, then seeing an immigration lawyer is important. A good immigration lawyers can be found by visiting AILA.org.

Unfortunately, the I-130 is not in Manila at the embassy, the Denial came from USCIS themselves not during the interview. The denial from USCIS usually means that you lack the foundation of that visa category, i.e. not married when filing and I-130, failed to respond to RFE, they suspect fraud, or that person's name came up on their security checks as being banned from entering the US. Most of the time the denial is because they filed the wrong form, and can be fixed by filing the correct form, but there can be cases where they alright deny the petition because of security background checks.

My mistake, I did not look at the timeline. But appealing within 30 days, contacting an immigration lawyer, and contacting senators are still valid suggestions.
