PLS HELP!!!!!! it's a mistake! I need your reply!!

Hi everyone! I just want have an idea about the petition of my brother. My mom petitioned us as single F1 (me, my sister and my brother). We received our letter from NVC (January 2008) to let us know that our petitioned is already on process. During that time, me and my sister discovered that out brother (43 yrs. old) gor married 1992. He kept it in secret because my mom might feel bad about him... HE GOT MARRIED BEFORE HE WAS PETITIONED by my mom. When we told this problem with our mom, she really feels disgusted and almost faint. Our brother was the most special among us (spoiled brat!). When we got another letter from NVC telling us to pay for our Visa Processing, my mom didn't pay for my brother because it's useless paying it. He's married and his petition is Single/Unmarried Sons F1... We are here in US already and we seek for a lawyer's help (Atty. Laguatan). According to him, he can still come here but should change his status from single to married. But sometimes this attorney is just bragging bec. my mom paid him $2,000, that payment will be until my brother will come here. But unfortunately, there's no news from him but to tell us not to worry, I think he's not doing any actions about my bros case...I was bale to call the NVC and told me that my bros case went back to USCIS because they found out that he got married and his case has to be PETITIONED AGAIN! Oh my God! I felt sad for my mom. My mom doesn't know this! ..ANYONE WHO READS THIS, CAN YOU GIVE A LITTLE ADVICE WHAT'S THE BEST THING TO DO. IS IT TRUE THAT THIS CASE COULD BE BACK TO ZERO?

yes,bcoz even if he attend the interview,he will still have the denial bcoz he got married.It happened to the brother of my mom's friend.When their father petitoned him single F1...he got married and thought the USEM will not knew about his status,so he went to his interview and he was shocked that the USEM found out that he's not single anymore and thats the reason of his denial.

thanks Bluemist! that will happen to my brother too if he continue to go to USEM for interview... I'm just bothered about this NVC told me that his papers went to USCIS wherein my mom will gonna apply again for a petition but our lawyer wants to justify that the petitioner is a US Citizen. How's that?

just recently when we are here already in the US, our lawyer made a letter that my brother was already married. It's better to tell the truth because we all know that telling a lie is a big issue, right!( We received our petitioned January 1993, my brother got married 1992) it's i think in my mom's case, she doesn't have any idea while applying for a petition for his son as F1 Single is that, he is married already)

Petition like this, they conduct a surprise investigation in the neighborhood...(just like what happenned to my boss brother)

They do investigation,most likely a secret investigation and applicants required to show proof of singleness too.

thank you for all the response and I think this is a big problem to my brother. all we know is he still can come here. I hope there's still other way, maybe he can come here for tourist. What do you think?

They (US Embassy) pays someone to do the investigation. And they are very good at it. It happened to my cousin. She was also petitioned by her mom as single, but she got married against her mom's wishes. They did continue with the petition. When it was time for her visa interview, her application for visa was denied by the US Embassy by reason of her being married. How did the US Embassy found out? Only God knows.

refiling again he will wait for another 10years..i don't know if the lawyer can do anything about it..u will jz b waisting ur money..that's what happened to my uncle who was petitioned by my grandmother..

if he can get a tourist visa there is a way..
