I guess the following language is in everyones first notice of action: "To best allocate resources, USCIS may wait to process forms I-130 until closer to the time when a visa number will become available, which may be years after the petition was filed."

YEARS???? are they just covering for unexpected delays or what - that language definitely concerns me.

Yes - some visa numbers takes "years" to come up.

Depends on what type they are. Spouses have no wait, while a "sibling" visa can vary 5-10 years. (not exact times ;))

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Ah ok - yeah i did realize that just wasnt thinking along those lines - :)
