Hi, my wife entered the US through Miami back in September, and she already has her GC. Back in September, we went to our local SSA, and were able to obtain her SSN without the need for a work authorization. Now and nine months later, her son, who is 19 years old, entered the US with a K-2 visa.

Yesterday, we went to our same local SSA, and I was told that he is not eligible to obtain an SSN unless he has a work authorization. I found this documentation at the SSA web site Employment Authorization for Nonimmigrants, which clearly states that a person with a K-1 is allowed to obtain an SSN without work authorization, but I am not really clear when it comes to a person with a K-2 visa.

What bothered me is that the SSA agent was telling me and showing me a supposedly SSA document yesterday stating that neither visa K-1 or K-2 categories was allowed to obtain an SSN unless there was a work authorization, and I know as a matter of fact that at least with regard to the K-1 visa he WAS totally MISTAKEN.

So my question is, could some one clarify for me what the above cite document says about a person with a K-2 visa? Does he/she have to have really a work authorization to obtain his/her SSN? I'd appreciate any clarification here, for I was reading that SSA web page cited above, and my brain does not get it yet. Thanks.

A K1 visa holder is allowed to get a SSN not so they can work but so that they can get a marrigae license (some states require both bride and groom to have SSN)

A K2 visa is for a Child under 21 of a K1 visa holder, the K2 does not need a SSN as they dont need a marriage license. If your son want to work, you will need to file for AOS for him and along with the AOS you can file for EAD, once he has EAD he can apply for a SSN.
