I-130 transfer notice

Timeline

Okay I sent my K3 paperwork to Chicago, got my NOA1 but not my transfer notice. When will I get that? Can I go ahead with the NOA1 and send the I129F paperwork to CA?

Filed K3 4/28/2009 (my husband had some issues with his Chinese visa)

CSC received May 1, 09

NOA1 May 6, 2009 (received in mail on 5-8)

Sent I29 May 9th, Received May 11th

NOA1 for I129 May 18th, 09

Received in mail on May 26th

I-130 Touch 8/14/2009, approved 9/1/09, 1129 touched 9-1,2,3, approved the 1st.

NOA2 for I-129 not received

Hong Kong Embassy received it on Sept 14th, 09

Packet 3 mailed out on Sept 22,09

I130 at NVC now

Received email Sep 23 about electronic processing for CR1

Packet 3 mailed on Sep 22, received on October 5th

Mailed packet 3 back 10-9 to Hong Kong, awaiting packet 4

Packet 4 mailed 10-15, Interview set for Nov 10th

In AP a little over a month

Got approval notice Dec 17th

Dropped passport off on 12-21

Received visa 12/24.

Flew to St Louis 12/29, now home.

Timeline

Not all cases are transferred, so if you got your NOA1 then you can go ahead and file the I-129F for the K-3 visa.

At this point, have you considered just sticking with the CR-1 visa. It will save you a good amount of money, and the process will probably be quicker, and you will get the benefit of a greencard on entry into the US.

Yes I have considered it, we married in Hong Kong. My husband is a foreigner living in China and we had to marry in Hong Kong. We were denied at K1 in 2007, married in 2008. The Hong Kong route is quicker than the China route and I can attend the interview with him in Hong Kong. If we do it the other way I believe he will have to go back through Guangzhou and I am not sure we want to go that route again.

When he went in for his interview they said they aren't use to foreigners applying for that type of visa and they were shocked that a woman was applying for him. On the normal side its men applying for their wives or girlfriends. Not the other way around. We never got an answer as to why he was denied, I believe it was my amount of visits.

You will never get a visa from HK if someone lives (wife/husband) in the mainland. I just went through this and they told us the wife had to interview Guangzhou.................................DENIED,,,,,,,,,,,,,,i brought a suitcase full of documentation, and they never looked a anything.

12/04 met online

04/05 met in Hong Kong (2 weeks)

09/05 petition sent I-129 via lawyer (what a rip that was)

04/06 trip to Shenzhen, gave her diamond (to small boooo)

11/06 interview

11/06 DENIED "not a bonafide relationship"

02/07 married in Hong Kong & Shenzhen sightsee (1 month stay)

11/07 I-130 sent in

01/08 NOA-1

04/08 I-129F sent

05/08 NOA-1

11/08 sent letter to cancel OLD I-129F (2005) petition so no problems

11/18 received confirmation (email) letter received (VSC working on the old I-129F) quickest response ever from any governmnet agency !!!!!!!!!!!!

11/08 13 letters sent to Senate Judiciary Subcomittee Immigration

11/25 mailed me for more evidence, don't understand this delay new

I-129F (05/08)

11/29/08 received request for more evidence.......I forgot to check "NO' for domestic violence, homicide, manslaughter etc etc,

how stupid of me gezzzzzzzzzzz someone KICK ME please.

Also received action to the old WAC petition I-129F to reopen to withdraw petition.

12/01/08 I checked the "NO" box and sent in to VSC.

12/02/08 requested expedite services (need life saving operation)

12/06/08 received email new I-129F back in process mode

12/19/08 denial to expedite petition (unbelievable)

12/30/08 USCIS sending why the denial old I-129F (cant wait to get that response)

01/03/09 Finally received both NOA-2's today, my heart cant take it.

01/09/09 Received 1st letter from NVC for $70.00......no no no I want to process the I-129F. Got my birthdate wrong, have to fix that.

03/24/09 Interview........DENIED HK

If we could of married in China we would have, we didn't have a choice. He is not a resident of China so we had to marry in Hong Kong. I know there are other couples that have been in the same situation as us and had to marry in Hong Kong that have gotten the visa.

The Consulate will look at, why did you have to marry in HK and there better be a darn good reason for that, an over whelming circumstance. All i know they will run the beneficiary through pure hell and all you can do is watch, you can't even go up to hold hands for support, just watch. I just left there, i know what i'm talking about. I wish you two all the luck possible. I would like to see somebody beat that system there and not a resident of HK.

We have a good reason, we are both foreigners. For your situation, is your wife Chinese? Is she a resident? We didn't have a choice, my husband does not have residency. 2 foreigners cannot marry in China one has to be a resident. That is their laws. That will be our reason.
