Hello, first time user here. I am hopeful that someone may have some answers for me. I am LPR and married for 16 years to US citizen and have two children also US Citizens. We ran into a huge financial hiccup in 2007, had to sell the house and husband lost job...horrible. As an alternative we travelled to Australia (where I am from) to get some family support and regroup. We were away for 14 months. Unfortunately everything we have done has not been planned, a retroactive response to lots of mistakes. So, I did not know about the problems of re-entering the country, my green card is good till 2017, so I didn't realise there would be a problem. I came back this past March to do a job interview in Boston, just for 4 days. On entering the US, they asked me how long I had been away - I'm honest - it worked out to be about 14 months. They let me know that there was a big problem with doing that, but let me in, gave me paperwork for the Travel Permit I-131, told me that I had to apply before I left the country. No problem, I downloaded the forms, got a bankers draft, sent it off. I was only in Boston for 4 days to do the interview. On the paperwork given (and filled in) no mention is made that you have to have the biometrics done BEFORE leaving. Makes sense now, but as I explained before, every action we take is retroactive...It would be nice to be one step ahead instead of behind. Anyhow, they sent through a biometrics time to attend, but I am back in Australia, so I can't make it. I have a contract for work in July that I have signed, I have my plane ticket to get to America, we are planning our move back. BUT, I will not have this travel document because I cannot make a biometrics appointment.

So my question is...

1.Does anyone know if I can enter the US with my Biometrics appointment letter and pending Travel Document? Will they be able to admit me into the country?

2.Can I reschedule a biometrics appointment to a day that is close to my arrival in the US?

I hope someone has some answers!

Big mess, you traveled BEFORE getting re-entry permit. More than likely your green-card is considered to be revoked. If you leave the USA and remin out of the country longer than a year, you need a re-entry permit.

You can look into getting a returning resident (SB-1) visa or may be required to apply for another spousal (IR-1) visa.
