Hi I'm Joe and this is my first post on here. Just after a little advice with regard to extending the NOA2 period.

I received the approval letter from the Immigrant Visa Branch of the US Embassy in London in late February but have not moved the process on any further due to the fact that my fiancee Jen is moving from Florida to Illinois at the end of this month. We feel it makes more sense for her to complete the move and settle there for a short period before I move to the US.

Am I totally correct in thinking that the approval lasts precisely 4 months from the date on the letter, as there is no date stated on the letter itself?

Should I write directly to the Immigrant Visa Branch requesting a further 4 month extension period?

Any help would be much appreciated.

Why do that?

Once you get the visa, it is good for 6 months.

You said the embassy has your NOA2? Now they are waiting for you other information, which is mostly stuff you do, not your petitioner. (other than the affidavit of support).

I would continue on, get the visa, then you are free to travel up to 6 months on it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I believe they have my NOA2 - the letter I received was worded "We are pleased to inform you that we have received an approved petition in support of your fiance(e) visa application....." with a link to the documents required to complete the next stage.

At what stage does the AOS need to be filed - am I correct in thinking it's at the interview itself?

Yes you submit the affidavit at the interview. What you can do is send your forms back without the checklist if you are not ready for the interview date to be issued yet as they won't send you an interview date till they receive the checklist.

Your petition is valid for 4 months from the date on the NOA2 rather than the when it was received by the embassy. The embassy will extend that date if it is still being processed though you may have to write and ask for the extension if it is close to expiring and you have not responded to them.

It should be on the copy of the NOA2 that your fiancee received from USCIS. If she never got it from USCIS she needs to contact them to let them know that as getting a replacement copy at AOS time is expensive.

Another place to check is the USCIS online case tracking if that is working for you.

Great - it worked! Now have the USCIS site setup to update on progress via email.

If you've already gotten your NOA2, I don't think you'll hear anything more from the USCIS at this point, anyway. You're in the hands of the Dept of State now (as are we!), I believe.

My fiance is from the UK as well and we just got our NOA2, so we're kind of in the same boat as you...feel free to PM me if I can be of any help.

Our Timeline

11/2001 - met online

6/2006 - first face-to-face meeting (he's been over 7 times total since then).

1/26/09 - filed I-129F with VSC

1/27/09 - package rec'd, NOA1 sent

1/30/09 - NOA1 hardcopy rec'd

1/31/09 - touched

4/29/09 - NOA2 email rec'd from CRIS! YIPPEE!!

5/12/09 - Mark rec'd Packet 3

5/29/09 - returned packet 3

7/12/09 - resubmitted packet 3 after being told for weeks that it was never rec'd

8/19/09 - interview scheduled for 9/11/09! Medical moved to 9/10/09.

9/10/09 - medical - passed

9/11/09 - interview - approved pending embassy receipt of medical results!!!!!!! Hard to believe it's finally done!!

10/2/09 - POE: Logan Airport in Boston, MA. Absolutely no problems, aside from the customs official not knowing what to do with the visa and having to find someone to help.

10/10/09 - Married!! :D :D :D

12/2/09 - SSN applied for in Montpelier, VT

12/7/09 - SSN received in the mail - that was fast!

1/9/2010 - AOS & EAD package sent

1/15/2010 - NOA's received for both AOS and EAD applications

1/22/2010 - biometrics appointment letter rec'd - appt is for 2/2 in St. Albans, VT.
