Hello,

Thank you for reading my inquiry.

I am an American Citizen, and I am trying to petition my fiance' to join me here in United States. My employer sent me outside the country ( Philippines ) where I am staying now. Luckily they sent me here in Philippines where my Fiance resident. Now, my Fiance and I are living together since my job is here in Manila. I am now using the same address as my Fiance's address here in Manila.

My question now is,,,,I might be staying here in Manila more than 1 year and my employer are requesting me to file and pay the taxes in Manila for over staying for another 3 months until I finish my project. Now, would that be a problem to NVC? Would they require more documents from me?. Please advise me of what kind of trouble would I be facing soon to NVC if I am not in my homeland temporaryly. Please advise me. Thanks

Why not just explain to NVC as clearly as you did for us here in a supplemental add-a-page to your application?

There is nothing that says that you have to be in the US to petition a foreign bride. Lucky you, getting to stay with your girl there while most men have to stay at home lonely while waiting for the papers to get shuffled.

NVC cares less about how long you stay there. Best to marry there and after living there for 6+ months you can apply directly at USEM using DCF [Direct Consular Filing].

Way faster than a fiance visa and she'll end up with a CR-1.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

What type of work do you do in PI?

You can PM if you don't want to answer on public forum

I wish I could find some type of work that kept me in PI for an extended time........

spouse petition/visa process could be longer unless you have the ability to file the I-130 directly with the consulate and thus avoiding the USCIS service centers. If you are legally resident in your spouse's country for 6 mos. or more, you may qualify for this alternate and many times faster process.

Who ever informed you didn't know about DCF for a spouse. Last one I helped a buddy with in PI only took 4 months. Main thing for you to keep domicile in the US.

Also to quailify financially. If you file US taxes you won't have problems.
