Hello,

I filed for an I-130 for my husband that is in the United States here with me, back when we applied I was a permanent resident. The application was received Feb 1, 2007. In May of 2008 I became a naturalized citizen, so our lawyer upgraded the application and it’s now in a new visa category as “immediate relative”. We were told by USCIS that the processing times for this application is 6 months.

According to USCIS the upgraded was received in September of 2008. It’s been more than 6 months and I do not hear from the. When I contact them they tell me that it’s pending background investigation.

We have been married since 2006 I do not understand why the delay, I was told that it would be processed right away since we had applied back in February of 2007. Has someone had the same experience??

Help please!!!

uhm.. sorry to hear that.

i tried calling USCIS, they told us that the 6 months adjudication period is not cast in stone. which means it may take longer.

i know some people who got their approval in 7-9 months. hang in there.

12.26.08 - Green Card Received :)
