Hi guys

My fiance may be laid off for a little bit coming up here and we were going to send in our K1 application next week. Is the income considered from his previous year's tax return?

Yes, but you need more than just last year's tax forms. You need to provide a letter form an employer, show pay stubs, steady income etc. The more financial info you provide, the easier it is. Seems like lately if they have even the slightest doubt on someone's income, they request more information or a co-sponsor.

As Sapphire said, it is considered but they want to see he is still working so he can support you. You might want to hold off on your K-1 application until he finds work again. If he ends up going on unemployment benefits, the US government may have a hard time approving your petition. (especially with the way things are going over here right now.)
