Hello Fellow VJ'ers :)

Posted this question on the main forum, I should have posted this particular one here..

My Fiance`e has sent me a copy of her province's Regional Trial Court papers ...I guess it would be and equivalent of a Divorce Judgement for us in the States.. It is labeled DECISION and the last page where the judge would sign it's stamped with the words ORIGINAL SIGNED and the Judges name in Capital Letters.

However it's not stamped with a court seal nor signed by the judge or clerk like a certified copy we would get here in the states Local/Superior courts.

It does say the marriage is Null and Void and an order date and the civil case number..I'm assuming the court system in the Philippines is old school? Would this be OK to include in the package as legal proof that she is again able to re-marry? I believe they will require the official NSO registration documents at the interview and not during the I-129f Filing? I'm hoping someone has seen such paperwork. Or am I worrying for nothing?

On a side note our lawyer for her nullification case, says the NSO records (CENOMAR) should be updated in a few weeks because the decision just came down last month.

Anyway is the paperwork I have on hand good enough to file the I-129?

Mar 9, 2010 - EAD Card in Production

I think USCIS will require the NSO stamped Certificate of Nullity and Court Decision. Your local civil registrar will send a copy to NSO, after a month or so it gets loaded into their system, then you can request for a copy.

Some courts name it as Finality and others Decree of Declaration of Nullity Marriage. You need it with the Decision for I-129. You can get the finality or decree after the Decision has been submitted to the Local Civil Registrar where she got married and the Local Civil Registrar where the court is if its different cities or municipalities. Photocopy of those 2 documents will be enough for filing I129f but when she has her interview in Manila, US embassy requires her to show the original copies signed by the judge and stamped with court seal and will need to leave photocopies behind.

So the documents you have right now is not enough because its not signed. If you have more questions, PM me.

When we filed the I-129F,we submitted both the decision and finality of my annulment and brought the original ones during my interview.Regarding Finality, I was advised by the clerk of court to get it after 2 wks.Your fiance should go back there and get her finality,then register it(Decision and Finality) at the local civil registry office,she'll be asked to come back to get the certification of registration.And with all the documents in her hands,she'll need to submit it to NSO Area B East Ave. Q.C.She'll get her MC with annotations after 10-15working days.

I spoke to her today, we are both disappointed that I couldn't mail it today. But it's better to be safe and 100 days later get a denial. We've been waiting for almost a year now to file.

ARGGGH Why couldnt these things take less than 90 days. OR Less. :(
