SEPERATION WHILE I-751 CASE IS STILL PENDING

Timeline

Hi my I-751 case is currently in CSC and my transfer date was 03/02/09 but my question is, what measures do I need to take say now since my spouse and I got seperated. I haven't filed for a divorce yet but I don't know if he has. I am currently in hiding because he was very abusive to me and had made thrats to kill me and I couldn't take it no more so I left 2 days ago. Do you guys think this will affect my case since it's very close hopefully to being approved (if it hasn't already :)). Another thing is, I got pretty suspicious that he might be withholding some of my mail but I don't know. I have (never had) any access to the mail which usually went to the post office box and pretty much that includes all my immigration stuff. I seriously need some help. Any advise or words of wisdom would be much appreciated. Thank you all!

1. Very sorry to hear that.

2. If he is abusive to you, then your decision of leaving him (perhaps temporary) is correct. Never stay in an abusive relationship, but I recommend you can try marriage counselling first.

3. Even if he file for divorce, it won't be finalized right away. I think he/his attorney at the minimum has to notify you of the filing first. I'm not sure about divorce procedure because I don't plan on having a divorce.

4. I'm not sure of your timeline but from your info, I think you're at VSC. Are you one of those who got transferred to CSC on Feb/March? Or have you been waiting almost a year already? When did you file?

5. I understand that you're tracking your status online from your other post. Until I know your timeline and more details, I'm not sure what to say for "him keeping the mail" part.

6. If you have moved out and have another address, you have to file the AR-11 form, I mean if you've already decided moving out permanently. If temporary move out for a short term cooling period (less than 10 days), then no need to file chnage of address yet.

7. Try work on the marraige. Here is hope for the best and prepare for the worst. Good luck on everything!

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010

* Thanks so much for your response. I actually filed at TSC and was transferred to VSC. My RD was 08/15/2008 and was transferred to CSC 03/02/09.

* About the counselling part he was very reluctant about it and always said he couldn't afford to got to one.

* I just moved out on Monday because he has been secretly planning something and he was very upset about me calling the police on him and since previously he had threathened that if I ever called the police on him an dhe goes to jail he was gonna kill me.

* The other thing is that he started to see other women (in the name of wanting someone to talk to but one of the ladies admitted to me that he asked her out to the movies and had been stalking her) about 3/4 weeks ago and that's based on the little info that I found out. I don't know if he was being unfaithful before.

* I just filed AR-11 Form today to have my mail sent to my new po box since I am not allowed to give out my current hideout address for my safety. All my mail like I said went to went to po box that I shared with him.

* On my part I would love for us to work out if he gets some help. But on the other hand, he seems to think he doesn't need any help and wants the marriage to be over.

I say contact an immigration lawyer soon, if you can afford it. Legally, no one is allowed to hold your immigration infomration from you. So if you have a lawyer, he/she can check with CSC on the status of your case deeply and help you move on without messsing with the law.

And, for what it's worth, change your address to your current one with the post office and with the DHS.

Did you file online or did you mail it out by snail mail? If you file online, you should have a receipt number, hopefully you printed it out too. Call the 1800 number, make sure they update your address on file and for all pending cases. When you call the 1800 number, make sure you ask if you have been approved or not yet. Second thing you can do is go online, chanage your address with USPS online. But it takes 14 days to be effective, hopefully the welcome letter and the actual GC takes more than 14 days, not that I hope it comes late for you, just that your husband can claim he never saw it even if he did, won't be able to make a case at court.

btw, my case was transferred on 03/02 as well, and I doubt that they have started working on those yet, let alone mailing them...but you can never be too sure. If you look at the list under the VSC to CSC tranfers topic, they are currently working and mailing the 02/25 transfers. So hopefully they have not yet mailed yours yet.

2. You need alot of evidence about the abuse. Restrain order and all. This will help you if you need a waiver later based on the abuse.

Don't just file an AR-11. That is not sufficient for them to effect the change of address (I know from experience that the right hand does not know what the left is doing at USCIS). Look at the address on your NOA and send a letter with your new P.O Box. In the letter, reference your case # for the i-751 and ask that this change be effected for any matters pertaining to your case number.

12/8/2008: Married

12/18/2008: Sent AOS package

12/22/2008: Package received in Chicago

12/30/2008: Checks cashed!

1/2/2009: Received I-485, I-130 and I-765 NOAs.

1/5/2009: Received Biometrics Appointment Letter

1/21/2009: Biometrics Appointment.

3/12/2009: Received EAD

3/13/2009: Received Interview notification for May 19th

5/19/2009: AOS Interview. Verbal approval received.
