Hello all,

We're going to apply for a SSN this week, but wondering if an expired I-94 will be a problem. My husband arrived in the US in December, we got married that same month. His I-94 expired Feb 19th, but we sent all AOS materials before that.

So, if we take marriage certificate, NOA's for I-485, will that be enough to get a SSN?

Just trying to plan in advance in case of any problems at the SSN office. THANK YOU!

From anecdotal evidence, it isn't possible to get a SSN with an expired I-94. You may need to wait until your EAD. You might as well try though.

I say anecdotal, because I don't have personal experience of it, got mine before I-94 expired.

7th December 2010 - Cheque cashed

3rd January 2011 - Biometrics

To be assigned a work authorized SSN an alien needs proof of age, identity and work authorization. Right now he has no proof of work authorization. Going to need an EAD card or I-551 stamp or card to be assigned a work authorized SSN and SSA will not accept a filing receipt or notice of action in place of the actual document.
