Folks,

Got a quick question. My spouse is planning to visit India in August and wants to take our one year old daughter so that her mother can look after her for couple of months. My spouse will return to the US after a month, leaving our daughter in India with her mother. Her mother (who has a 10 year US visiting visa) will bring our daughter back to the US after couple of months.

My spouse is an Indian with green card and our daughter is a us citizen.

My question is..how do I go about doing it? What options do I have? Any information would be very helpful.

i had a similar question yesterday, i pretty much knew the answer i was just looking for the correct form, im not sure, because its a bit of a here there and back again situation, and im not really sure about your specific question, maybe it is how to avoid problems, and pretty much ensure that your mother-in-law can bring back your baby to the U.S, but if you and your wife sign a form in front of a notary saying that you give your mother permission to have the baby outside of the U.S from such and such date and to bring her back to the U.S on such and such date, that may take care of problems. That's kinda what my husband are doing for our niece when we take her to mexico with us this december. hope this helps!

Your daughter needs a airline ticket and a US passport, don't know about a visa to India, nor do I know if she needs a letter of permission to bring her back from India with your mother-in-law. DOS site tells all that stuff.

the reason why i said a letter of permission because i hve heard its a necessity, or a big deal to make sure that if a minor is traveling outside of the U.S with someone other then their parents, the person with whom the minor is traveling needs permission. it helps protect the child, and the person so they dont get in trouble for kidnapping. i thought that the passport and plane ticket was an obvious. if you want to see the set up of the form let me know and i will post it.
