Manila Embassy Interview

Hi everyone,

Thank you all for the good luck wishes but lady luck wasn't on my side today. I've been put on AR.

The long story is that I married my ex-husband when I was 20 and did not get consent from my parents. It was a secret marriage. Then five months after our secret marriage (and bothered by consciense), I married the same man again for the second time, this time with parental consent. We used the second marriage as our "official marriage." So 17 years later, I filed for annulment and forgot about our first marriage. Our second marriage has been declared null and void but the embassy wants the first one declared invalid as well.

My interviewer was kind. He said that for all intents and purposes, I am not eligible to marry and would've been denied a visa outright but since I have an annulment decree for my second marriage (to the same man I married the first time), he said that they will keep my file with them and wait for me to submit another annulment decree. I have one year to do so otherwise, we will have to re-do the whole K1 process again.

I'm on my way to see a lawyer now. I'm hoping to get the court to say that my annulment which invalidated my second marriage has also invalidated the first marriage since it was the same man anyway (but I really doubt that very much). I may have to do the entire annulment proceedings once again.

This is just a setback. It's something that cannot be overcome.

Oh by the way, the consul cancelled my multiple entry US visa because he said that I have already signfied intent to migrate. I said that I've always acted in good faith and not once did I violate any of the visa terms (I've had a US visa since 1991 ad has travelled 12 times to the US). He said that it is difficult to overcome the assumption of migration. They also kept my passport so now I can't even go to Hong Kong.

To those who want their timeline posted, I will do that tomorrow. I have to go see a lawyer first.

That number worked perfectly..the poor girl sounded so tired and over worked lol She is very sweet. I had a copy made and forwarded...supposedly.

Really sorry to hear that patiently waiting, but as you have said this is only a "setback". I really hope that it is only a short setback.

Hmm... it seems that what i had posted from the manila virtual embassy chat session was accurate and that many visa have problems because of former marriages. That is really food for thought. I have only been on this site for a little while, but first i have seen jazzy have a former marriage affect his fiancee and now PW.

There is a lesson here for people who have "unusual marriage circumstances". Triple check to make sure that within the eyes of the embassy officials that all previous marriage have been anulled.

Really hoping that judge says that the one annullment is all the is neccesary for you PW.

Really sorry to hear that PW, hopefully inquiring to lawyer at once will do this process more possible for you in time comes.

I, had worried once ... but i'd never been married with my son father, and when i delivered my son, the hospital attendant didnt want me to use my exboyfriend surname for my son since were not married.

I dont know how i feel now... before felt so sad that my son wont recorgnize any middlename since he will be using my name as his surname. But now i do feel lucky on this matter of being petitioned with my son along becoz, he is able to have a new life with a new found father-to-be that willingly to have his name on my son surname. Altho, exboyfriend knew about wats life we have now, he cant do harm to us, bcos he rejected me and son since from start and everything was in legal way now.

Hopefully, i wont be having problems bringing my son with me along with my future husband. Tho i still give faith to DSWD that i have all the rights for my son and i filed my CENOMAR document legal.

Everything was happening to all of us, for the purpose of we needed to be reminded for single dots.. of our life since birth.

i am so sorry to hear that.....anyway...your not alone of starting all over again...now i realized that GOD has his own plan to all of us....just keep your love alive, that's the most important thing. soon my anullment would be final and we will get married by april and we will start our journey again. just be patient again...and again.... :D

That seems silly to me, if you married a guy twice why would you need 2 annulments for one marriage? Not sure why they would take your Passport either, not like you can enter the US without a visa. :bonk: Anyways, hope it goes well. I guess we aren't the only ones who have to wait now....welcome to the club! :P:thumbs:

BTW, My fiancee's BC might only take 3 months being a typo. Very good news for us! :D:dance:

Wind, it's a technicality thing. I forgot about this first marriage and so it was never mentioned in my petition for annulment. Had it been mentioned, it would have been annulled in the same court decision as well.

Sorry if I made it sound as if the embassy hostaged my passport. The reason the embassy kept my passport (and I'm glad that they kept it) is because they will wait for me to submit the annulment decree for the first marriage. It means that they are not sending back my file to USCIS and I will not be doing K1 process all over again. If I am able to submit the annulment decree within one year, they will give me the visa (I hope). I can request to withdraw my passport if I have to travel out of the country. The embassy people are not so bad. I was happy to note that the people there have hearts. I really appreciate my consul for not denying me the visa outright. He actually gave me a chance to rectify my case.

Hey Jazzy, yes, I guess we're on the same boat. If I'm lucky though, I may be off the boat in a few months. Oh well, there's a reason why all these is happening. We just have to trust HIM.

No, according to the law requirements you don't need a lawyer for a middle name typo but my fiancee did E-mail that lady and she said it would be 3 months for a typo and 3-6 months for a name change. I'm really not sure if that means it's faster to go with her or if it just takes 3 months if you do it thru the local registry, or if there is even a diff in time. Not sure what the price is either, I'd rather do it thru the registry without a lawyer but if it's faster Bawo. Anyways, she is suppose to E-mail her again and ask the price and if it's faster. :unsure:

Subject: RULES AND REGULATIONS GOVERNING THE IMPLEMENTATION OF REPUBLIC ACT NO. 9048

Pursuant to Section 10 of R.A. No. 9048, which took effect on 22 April 2001, the following rules and regulations are hereby promulgated for the information, guidance and compliance of all concerned parties.

PRELIMINARY STATEMENT

Article 376 of the Civil Code provides that "No person can change his name or surname without judicial authority.". Article 412 of the same Code provides that "No entry in a civil register shall be changed or corrected, without a judicial order.".

Republic Act No. 9048 amended Articles 376 and 412. Section 1 of this amendatory law provides: "No entry in a civil register shall be changed or corrected without a judicial order, except for clerical or typographical errors and change of first name or nickname which can be corrected or changed by the concerned city or municipal civil registrar or consul general in accordance with the provisions of this Act and its implementing rules and regulations.".

Rule 3. Who may file the petition. ? Any person of legal age, having direct and personal interest in the correction of a clerical or typographical error in an entry and/or change of first name or nickname in the civil register, may file the petition. A person is considered to have direct and personal interest when he is the owner of the record, or the owner?s spouse, children, parents, brothers, sisters, grandparents, guardian, or any other person duly authorized by law or by the owner of the document sought to be corrected: Provided, however, That when a person is a minor or physically or mentally incapacitated, the petition may be filed on his behalf by his spouse, or any of his children, parents, brothers, sisters, grandparents, guardians, or persons duly authorized by law.

PW, that is such a total, complete bummer--I'm sorry to hear about your setback. :crying: I'll pray that the court looks at it and swiftly rubber-stamps the re-annulment. At least it seems they are working with you in this! Good luck to you, and if it helps: at least they caught it before filing for AOS. Now that could have been a mess and a half.

Wind - I hope the BC gets straightened out really soon. One typo due to someone's carelessness, and... :(

Frankly, pretty much the only thing I'm nervous about is my previous marriage. (Yep, another high-risk divorced person.) Everything is in order, don't get me wrong--but all I ever got was a Notice of Entry of Judgement (stamped as being filed, and then sent via mail, but no signature anywhere on it), and the Judgement itself which was a signed copy (but still a copy) and a couple stamps saying it was filed. Logic says it should be no problem (the doc's 8 years old and shows it, plus filing single on my tax returns, plus paying child support...) but ya never know.
