Good day!

I came here in the US last June and got married on July which was within 90 days after I got here. But I haven't applied for my AOS yet.

I am planning to apply next month though and I have couple of questions just for clarification.

-- Are the requirements for AOS still the same as stated ON THIS LINK ? If not, kindly send me a list of the complete requirements.

-- Would it hurt us applying this late cos I had my med exam April of last year so it would expire this coming April? If so, what would we need to do?

That's all for now. I hope somebody can give me a clear answer for my questions. Thanks a lot! :)

If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)

This is outdated as there is no longer a form I-693A. They have combined the vaccination supplement into the new I-693 form. You are supposed to fill out the first part with your information, then take it to a civil surgeon and show him your immunization records and he will write them in the I-693. The problem people have is that many, many civil surgeons insist on a new exam at high fees and won't do the vaccination part only at a nominal fee, so call around. You're pushing it for the one year limit on a medical and USCIS may or may not let you get by with it, but you can try. They are supposed to go by when you mail in the application, but who can predict what the person picking up your case in 5 months will decide to do.

12. I-864, Affidavit of Support (see poverty limits here)

>> Include any additional required supporting documentation

If you happen to have a co-sponsor, be sure to send something to show their status in the US, like birth certificate photocopy or passport biographical page photocopy. If they are not native born in the US, then copy of green card or naturalization papers. Lots of people fail to do this and get an RFE

13. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

>> Include any additional required supporting documentation or photos as well as payment as noted here.

The guides weren't clear enough for me on this. There is no additional fee. You will submit with this I-765

Passport Photographs (2)

Photocopy of passport biographical page and K1 visa page

Photocopy of Form I-94 Arrival/Departure record

14 I-131, Application for Travel Document, if you need to travel outside the United States while your application is processed (optional)

>> Include any additional required supporting documentation or photos as well as payment as noted here.

The guides weren't clear enough for me on this. There is no additional fee. You will submit with this I-131

Passport Photographs (2)

Statement of circumstances that warrant issuance of advance parole

Photocopy of passport biographical page and K1 visa page

Photocopy of Form I-94 Arrival/Departure record

If you are doin AOS, EAD, and AP then think of it as 3 separate applications that are going off in the same envelope but will be processed separately at different places. That's why you duplicate things you are sending....like two photos with each application so 6 in all.

Thanks for y'all reply.

@Nick-nick: Thanks for all the information. I'll take note all of that.

@Haole: I know. I'm actually out of status now but circumstances weren't expected to happen but we'll apply for it asap. I'm actually getting ready now, that's why I'm back here trying to gather necessary infos that I needed.

--More question:

Regarding the I-693, where can I get the form? And I've heard that Dr. Arnold from Austin, TX can also do it, is that right? Cos I live in Austin, TX and they said he only charge $30.00 while civil surgeons suggested by USCIS charges couple of hundred dollars.
