07/08 tax

okay,im still lost and dont know what to do...

my husband did not file his 07 tax.. (thats why my case is still pending due to delay of AOS coz of his tax)

now, he is about to file his 07 and 08 tax with my W-7..i sent him just a notarized photocopy of my passport..

i read on some post that W-7 should be mailed to process the ITIN and then the return will be processed..

if im correct,it would take 4-8 weeks?? he needs it asap to be able to send it to NVC..

-for his 07, can he just file it separate so no need for ITIN? so he can send his AOS to NVC? and for 08,can he just file for extension and file it when i get to US and have my SSN?

i really need advice

06/29/12 - NVC received case

07/09/12 - case entered in the system,assigned MNL # and IIN,email add given

07/12/12 - beneficiary emailed DS-3032, auto response received

07/18/12 - AOS fee bill/paid "IN PROCESS"

07/20/12 - AOS fee bill shows "PAID", mailed AOS package

07/25/12 - received AOS

07/25/12 - IV Fee Bill Invoiced, paid $230.00 "IN PROCESS"

07/26/12 - IV Fee bill shows "PAID"

07/28/12 - mailed IV Package

08/03/12 - received DS 230 packet

08/14/12 - sent RFE

08/16/12 - NVC received RFE

08/21/12 - log in failed

08/22/12 - case complete!

09/26-27/12 - medical at SLMC

10/04/12 - interview

12/01/12 - Left Philippines

Have your husband take the W-7 and both the 07 and 08 returns to his local service center. They will accept both returns and the w-7 and stamp and make copies. He can then send copies of the copies . You dont need to offically get the ITIN before the return is filed.

so he can just go to his local IRS office and file his taxes?will they process it even i dont have ITIN yet?

i didnt notarized my proof of identification correctly, ya he can file his taxes together with your W7 ..

ruby did they ask for the RED RIBBON/GOLD SEAL from you as well? when i got my wife's ITIN we had it returned the first time also because they wanted that copy with the ribbon and seal on it.

i only sent him notarized photocopy of my passport,and just notarized here at a public notary..

so they still process the taxes even u got denied of ITIN?

did he just went to IRS office or mailed it?as per instruction?
