ok- ive read up on this situation here on VJ and other places on the web

and im more confused than EVER! lol

here is my situation-

*i have not recieved any notice of NOA2 yet, still patiently waiting

*my finace (male/jamaican) has a SS card with SS number, in 2007 he was in the US on a H2B work visa

*the SScard says its valid with DHS authorization....

*if he is able to arrive in the US anytime before october, i am positive that he will have a willing employer

(the employer being his old H2B employer)

ok

*IF he is here in time, and IF he gets the stamp might he be able to work?

Which type of visa is he coming over here on?

Nevermind, just saw your timeline. If he's coming on a K-1, he can't legally work until he has either an EAD or his green card.

If this is the case then why are JFK still issuing the temp work authorization stamp? Again, it seems that nobody has been able to fully confirm that those given the temp stamp cannot work, the evidence so far actually suggests that people can. The difficulty of course is finding work in this tough climate but that does not mean it is impossible or not worth trying to find work. There is so much conflicting information floating about on the web when it seems people can and are working on the K-1 with the temp work authorization stamp. I am personally trying to find work right now and will let you know how my search goes.

Just thought I would let you know that my employer just tried to verify a persons work status as per the new E-Verify service. The person is a K1 visa holder with the EAD stamp on the back of the I-94 and the result came back "Not Authorized for Work" The person entered through JFK 3 weeks ago and has a valid SSN.
