Hi,

I came to US with a K1 visa. We got married just a few days ago(!!!) and we are now filling out the AOS documents. We came across the i864 form.

My husband has an income just a little below what is required (around usd 17 000). He is doing his phd and this is what they are paid as stipends. I just got here and I dont yet have working permit and a job. But I do have an apartment back in my country-in Turkey which is worth like usd 150 000. I had submitted the deed (its english version as well) to the embassy in Ankara together with my other K1 application documents. It is rented and I collect its rent as an income. But I didnt bring the deed with me again as I had already submitted to the embassy.

Do you think my husbands earning would be a problem? It is only a little less than what is required. I have a mfa and my husband is soon completing his phd. What do you suggest we do? Do you think I should ask for a copy of my deed from turkey again with its english version or does the embassy forward all the info?

Congratulations!

The USCIS looks at your sponsor's ability to support you. It would be best for him to find a co-sponsor to avoid any questions about that ability. Your income from Turkey can be proven by Turkish bank and tax records, and it can help.

I'm new at this and I'm going through something similar at the moment. But a little less than the required income is akin to being a little pregnant. A little less is not enough and you need to prove otherwise. He can use assets to make up the difference provided he has 5x the spread. Or you can use your own income or assets, which sounds like your best bet. You can also have a second sponsor provided they share the household with you though that may not be your situation. Thanks a lot Old Dominion. We just remembered that my husband is granted a fellowship for usd 2000 and if we add that, he will be above the requested income level. Do you think a fellowship will be accepted as an income?
