My name is Tom, Im married to my wonderful wife of three years, we have a two year old, and we have been trying to figure out her residence status for quick long now.

We got married on Jan 06, and than on Jul 07 we filled her paper work ( I-130, I-485) later on Jul we received both confirmation staying that her paper-work had been received and in process. In Aug we got a notice with a appointment to get her biometrics done. Sometime between that we got her interview with an immigration officer, this officer took her visa, but denied her case due to my low income, he asked us to filled a Joint Sponsor, we only had 30 days to do it, which we didn't know about it until we got a letter saying her I-485 application had been denied, but her I-130 was approved. Since her case was denied we decide to wait until I had my tax return from 2007 to filled again, not to add that we had to pay the new feed for each application.

In July 08 we filled again, in Aug she had her biometrics done again. Now on Sep tired of wait since the time before was so much quicker we call immigration to find out what was going on, to come to find out that her case was terminated way before she had her second biometrics done, however, on Sep (after we called) her case was reopened. the letter read... the application is now awaiting an interview. Should you not be contacted within 90 days call the NCSC. We got the letter Sep 11, 2008. We should had received something by Dec or Jan the lates, What should we do? We called several times but they keep saying the case is pending. Now What?

Tom,

Try to schedule an infopass appointment to get a little more information about what is going on. Everything sounds so tangled up, more information would definitely help you sort through this.
