Hello everyone,

I have submitted all the necessary documents for AOS, and My wife (USC/petitioner) and I are worried now that we might have used wrong form for joint sposnor.

We used form I-864A for my wife's sister, who lives in other state and my wife does not apper in her recent Federal income tax return documents as a dependent. Should we had used Form I-864 then?

We though that any US citizen with a family relationship can help the sponser to finance and meet the poverty line requirement.

But more that we researched, the more confusing it has become.

However, my wife does apper in her parents jointly filed tax return until 2007. But we don't live with them. Could we have used her parent(s) as a joint sponsor? If yes then which form would they use?

PLEASE! If you have any asnwer to this problem/confusion let me know.

In that case I will be expecting a Request for initial evidence, I suppose.

If that's the case, shold I ask my sister-in-law (USC) to fill out I-864?

The instruction on I-864 states that "A sponsor completes and sigh form I-864, even if a Joint Sponsor also submits an I-864 to meet the requirement". Does it mean that my wife (primary sponsor) fill out another I-864 for her sister, and sign it?

You wife's sister must complete one I-864 as a joint sponsor. Also, your wife must complete one I-864 as well as a primary sponsor...In this case there are two (2) affidavit of support.

Got it! Thanks for the info.

My wife has already submitted her I-864 in the original application package.

Should she fill another again?

If your wife's income is not sufficient to meet the poverty line for 2 person, USCIS will send you an RFE....wait until you will receive an RFE from USCIS and follow everything what is written and response to what is asked .....you'll be alright...good luck!
