Timeline

My fiance wants to stay in the city to have ready access to computer and mail, rather than go back to her village. She's thought of getting a job. However, she was told even to be a sales clerk, you are expected to committ to the job. IF she were to quit before 3mos of service, that they could "take her to court".

I asked her if what they mean is that she might owe them for training her, or the costs of processing employment. However, she seemed pretty clear that they were telling her it was some sort of civil {criminal?} penalty.

Can anyone shed some light on this?

i dont really get you..but in the philippines there is a contract that you need to sign if ever you get the job like 3 months or 6months contract...maybe the one your saying about taking her to court means they can sue her for breach of contract if ever she will quit the job...thats what i think.

i dont know if its correct.

many companies are hesitant to employ individuals who won't be staying for at least 6 mos. they'll be investing money to train and hire you so if you're just going to leave, why should they bother hiring you? they would want to be able to rely on you in the long term. plus it's another expense to find your replacement.

on the bright side, there are temporary jobs your fiance can apply such as being a crew for catering services, staff member of an event. there are many gigs of that kind in the phil. also there are jobs that give 3 mos contract. she should ask around among her friends. i hope she finds one!

but....ok so u signed a contract usually 6 months minimum (and temporary positions such as sales ladies/cashiers are thrown or recruited under "placement agencies" and its called "probationary period" if its a permanent position) i doubt if any company would go over the proceedings to sue an employee who didn't finish his/her contract(unless maybe its a managerial/ CEO's level). What she should do is to file resignation (when she decides to leave) giving 30 days grace period so that she departs from the company with good reputation rather than abruptly quitting and ohh well... you never know when u need another job again. Karma eh

I work as an hr back in ph. (if that helps) ops! even then, read the contents of the contract before signing anything, to be sure. Maybe rules and regulations have changed now in ph. (been 2 yrs since but i doubt coz i keep in touch with my former colleagues)

In what she was explaining to me, that was in inquiring about a job as a sales clerk in the department store. She didn't mention the contract, but perhaps that was what the employer was talking about.

Yes, I think there ought to be plenty for her to consider without having to sign any sort of contract. Still, we're hoping our NOA 2 won't be much longer than 4mos away, so it would be a temporary job. :thumbs:

I don't think so they sue her, if she will send a resignation letter.

She must think ,that during medical examination and interview

she will absent to her work and thats hassle for her cuz not all managers allow

their employee.She might get stress.Remember the st.luke medical center are very strict

in the medical examination.

Tell her to read the resignation part... the requirements... if the company needs one week - four weeks notice.

I would suggest for her to apply directly to the company not thru an agency. I heard that agency always have this provision that if you dont finish the contract, you have to pay a certain amount... She should take note of that amount.

Never heard of anyone got sued for not finishing a contract. But since you are applying for a visa, just be careful.

mall in the Philippines especially Henry Sy's SM they usually are contractual and it takes 5 months... and that's it.. but if she works for example in Starbucks ( i worked there part time) i was given a bond of $24,000.00 for three months if you decided to not resign , you have to pay it.. or you can talk to the HR manager they can still waived it for you depending on the reason for leaving.. (i think that was the cost of hiring )..

but not sued,.. unless she tells them, "i would just like to work for a a few months" you dont say that when you are applying for a job...

i have done that too with my ver most recent job (Financial Times) the panel asked me, are you going to stay? at that point, i said yes, because we havent passed out application yet, but that doesnt mean i dont have the intention..

Goodluck, i suggest, she works at a starbucks, not a fast food chain.. its kinda tiring in the fast food chain.. she will hate it..

Sounds like she was talking to an employment agency. Unless she signs a contract, she has no obligations. Too many employers there are crooks anyways!

Thanks all. I told her to not feel pressured and to do as she decides. In any case, I wouldn't want her doing any job that has something like that hanging over our heads for us to be concerned with.
