Question about age for K1 visa-Philippines

Timeline

Hi, my fiancee is 17, she will turn 18 this may, 2009 (Im 22 by the way).

I visited her in the Philippines for 3 weeks earlier this year.

My question is, Can I start the K1 process now, even though shes not 18 yet? I mean by the time they process the petition shell be 18, right??

Or will it cause problems? Should I just wait?

By the way, I have her parents consent, so the parent's letter of consent is no problem.

March 9,2010- Hard copy received

March 12, 2010- I-485 receipt notice for interview

March 18,2010- received letter for initial interview

April 19, 2010- 8 :15 A.M INTERVIEW DATE ( APPROVED 5min.Interview)

APRIL 20, 2010- USCIS website updated card production ordered

Please wait until she is 18yrs.old to avoid any problems in the future. Hope you have a happy trip with your loveones.

To get the CFO stamp you will need parental approval at that age.

She's legal to marry in USA if she's 17 with parents approval.

Seems like the CFO would be the key here.

Iwould say you should wait to avoid complications....she is still minor...

you only have 3 months to wait for her to turn 18. just stretch out your patience for the meantime...and I think though 18 is legal age in the Philippines, you still need the parents consent on you petition.

I'm with everyone else who's told you to wait a couple extra months. However, the issue of her age is more for the CFO. For their purposes, I put together a letter with language similar to this.....

To Whom It May Concern:

I {father of fiance} am the father of {beneficiary}. My family and I approve of our daughter's decision to marry

{USC Petitioner}. She has our support and blessing in her new future in the United States.

Sincerely,

{father of fiance}

I left room for her dad to sign it under the salutation. Then, we photocopied dad's voter ID card which has his matching signature. I not saying it's the only solution, it's just that when it comes up in your case it's comforting to have on hand with you to present to the officials.

I think the key is to wait :thumbs: You will still have to deal with the CFO but if her parents approve you shouldn't have any problems.
