Difference between K-3 and 130 visa

A visa petition is not a visa application, a petition and a visa application are not one and the same.

An I-130 visa petition is a request that your marital relationship be recognized so as to qualify your spouse to submit an immigrant visa application. Two separate, although related, things. Many people submit I-130 petitions and have them approved but never apply for a CR-1 or IR-1 (as appropriate) visa - because they apply for and obtain a K3 visa and then adjust status instead.

Although, if they wish, a K3 can apply for the immigrant visa rather than apply for adjustment of status. You are correct about that.

CR-1 is an immigrant visa.

K-3 is a non-immigrant visa. You'll need to adjust status when you come in with this visa.

You don't necessarily have to adjust status if you come in with the K3. You can return home to complete the CR-1.

So by filing the I-130, I have automatically filed for the CR-1, correct? The two are one in the same?

And by doing this, then we do not have to fill out the adjustment of status papers, however, it may take longer than the I-129. Is that right?

So another question, I am finishing up the I-130, and it asks for the Alien Number, should I put None, or put the one he had during his fiancee visa?
