Hi Hannah,

Hoping for a safe flight for your upcoming trip to the US. We are both May filers in the K1 forum.

I agree with you on writing business plan... it helps in giving us better perspective on our future endeavours.

I've been dreaming of setting up my own business for years and when I met my fiancé and we decided I would move to him, I had to change my research to USA business laws. I find it a bit confussing at times, but I found a dealt good book on line that covers from studies to setting up on your own and comes with a cd with extra info\ helpful forms and it's more usa orientaited though it's applicable to different countries. It is the how to be a ......(insert poffession/job title) I have also learn't about there being two different types of laws pertaining to setting up business. The federal ones (main gov applicable to every state) and then the state ones which can vary from state to state. I am still trying get my head round these. I am also trying to get my head round the difference in lingo. Permits and licences and stuff. Eventually I will get my head around it but recommend doing a business plan it's good not just to present to the investors but I find it helps me iron things out in my head. There are lots of helpful sites on line that give u templates on what a business plan looks like.

Not all businesses require permits/licenses. If it is a retail business, you will most likely require a seller's permit, if your state has sales tax. If your business is within an incorporated area (city limits), you may need a local business license. Certain professions are require licenses.

I live in an unincorporated area, and the state agency that regulates my business does not require a license. I do have a sellers permit, so I can collect sales tax, and purchase merchandise for resale without having to pay the sales tax.

How do you know if you live in an incorporated area or unincorporated area. Where do you look for it?

Would it be in the IRS, SBA website?

It is a local government distinction. If your business is located where there is city government, you are in an incorporated area, and subject to their regulations. If your business is not located within any city's boundaries, then you are in an unincorporated (provincial) jurisdiction

thanks for responding about the licences/permits. I know that i dont have all as not everything is applicable to everyone. its just working out which ones are and are not. :wacko:
