Hi, I'm atsumu.

I'm now F-1 student(Japanese)/OPT and getting married this Friday in San Francisco.

And I'm preparing the forms and supporting documents for adjustment status to GC.

I need to apply for an adjustment status before my OPT expires as of June 15th, 2009.

I'm reading some documents such as I-485, I-130 and got a little bit confused.

Some of my friends who applied in the same way(F1 to GC)said I don't need to get criminal record from Japan since I'm in the U.S., but other says I must get one!

Do I need my criminal record from Japan as a supporting document??? I know I need to get finger print when I'm notified to do so before the Interview, but about a criminal record, I have no idea.

Since getting the criminal record takes a couple month, I have to start to get one if I need it.

In addition, if I submit the documents for the adjustment status before my OPT expires, do I need to stop to work even though I have a valid work permit until 6/15/09?

Please let me know,

Thank you!

No you do not need the police report. I think when you submit for AOS, you will need a new EAD category c 9 because now you are working with c 3. I am also an F-1 student so I understand your confusion.

Hi, ghed!

Thank you for prompt reply!

I see. My friend scared me yesterday that you MUST get the police report, I swear!!!

And about a work permit, so once applying a new EAD with category c9, will my current EAD be invalid?

For example, if I submit the form to apply a new EAD on April 1st, do I need to stop working even though I have a valid EAD until June 15th?

No, you don't have to stop working. As long as your EAD is still valid, you can keep working. The only time you need to stop working is when your EAD is expired and your new EAD (based on AOS) has not been approved by USCIS

Hi, w1331

Oh, that's great!

So, I should apply for a new EAD with GC documents as soon as possible, then I don't need to stop working if I get a new EAD before my current EAD expires!

One more thing,(sorry so many questions...)I'm going to change my last name after getting marriage certificate(maybe next week or so) and before applying for GC. such as SSN, ID, Passport, bank accoung, etc

In that case, do I need to change my last name of my current EAD card?? I don't think so, just make sure...
