AOS, is it necessary to send the joint taxes?

I was wondering is it really necessary to send that we filed taxes together on the AOS package. Reason why I can't send it now is because I'm still waiting for my baby's SSN in order to claim him in my tax return but since he was born mid-November of last year, it takes about 3 months to get it. And so far I haven't received it but at the same time I don't want to wait much longer.

So can I send out the AOS package now with out the taxes information? I know I have to send what I made last year, which I do have, but the joint file is what's bothering me.

You need to send the USC spouse's most recent tax return as supporting evidence for the I-864 (and the cosponsor's as well, if you have one). This will most likely be the 2007 return you filed in April 2008 (when it was not possible for you to have filed a joint return). You do not need to send a joint tax return at all.

If it turns out that you do file a joint return before having an AOS interview, you can use the joint return as proof of financial co-mingling, but you don't need any co-mingling evidence until your interview, and there are other things you can use, such as joint bank accounts, anything showing each other as your beneficiaries, a joint lease on a rental or joint deed on your home, bills in both names, things like that.

My husband's GC came in the mail last week and we will file our first joint return in April.

Thanks, that way I won't lose time on filling joint taxes now and save it for the interview(s). THat way the package is in now and not later on when the system clutters up again.
