since I am still a student and currently go to college i havent started working yet.........so I dont have any income or tax returns etc...........So either my dad or my brother will be sponsering my husband...........to my understanding i still have to fill out an I-864 even if my income is zero?!?!?!??! and anyone who is sponsering besides me fills out the I-864A????? Thanks alot for your help! :thumbs:

yes that is correct, but does your brother or dad lives in same houshold if so then yes they will fillout I-864A. If they live in different house then you then they fillout I-864.

yes the I864 you fill out even if you don't have income as the petitioner, if your father or brother is going to sponsor they would use the I864 form also, The I864A is for family members in a household who could be considered counted on a sponsors I864 form as possible dependents, this is used to show a household member is not dependent on the I864 sponsor. That is my understanding of the difference between the forms. I am sure someone will correct me if this is not the case.

Thanks alot for your answer...and yes my dad and brother live in the same household as me...so I'm guessing they will fill out the I-864A form....

i was in the same situation as you just a couple of months ago. I'm a medical student so I didn't have any income taxes ever since I was in pre-med. So My dad co-sponsored my husband. Just make sure you write a letter attached to your I-864 statting why you didn't file any tax returns. I also attached my school records and transcript to show that I have been in school and did not engage in any type of employment other than my volunteer activities.

My dad and I are in the same household so he filled up the I-864A. I filled up the I-864. Note that if you find a co-sponsor that does NOT live in your house, that person must fill out a I-864 as well.
